CLIENT BACKGROUND & PLANS
The Client, Aspen Owner, LLC., is planning a major renovation the fall of 2023 for the
Saint Regis Hotel Aspen spa located in the underground section of the hotel. This major
renovation will require impacts of disturbance, detachment, deconstruction,
demolition and disposal (5D) of the various building materials, of which some are
suspect asbestos containing materials (ACM) or suspect asbestos containing building
materials (ACBM). Prior to 5D, The Client is required to have an asbestos inspection by
a State of Colorado CDPHE certified asbestos inspector who will collect bulk samples of
the suspect ACM/ACBM and have those samples analyzed at a certified laboratory for
asbestos content. The Client hired HealthSafe Inspections, Inc. (hereinafter, HealthSafe)
to perform a limited asbestos inspection for the spa-related areas for the slated
renovation.

VISUAL INSPECTION & LABORATORY FINDINGS
An inspection was conducted by Jim Baker of HealthSafe on Monday, April 10, 2023,
with maintenance staff and later the spa manager present during the survey, inspection
and sample collecting. All suspect ACM/ACBM were identified by homogenous
materials and sampled randomly respective to the scope of those materials slated for 5D.
The samples were collected randomly so that no two samples of a homogeneous area
were collected side-by-side and best represented the entire homogeneous areas having 5D
impacts. The suspect ACM/ACBM collected and analyzed by EPA 600 Method PLM
analysis are the following:
1. Skip-Trowel Surfacing Texture, a homogeneous trowel-applied surfacing
material/texture [samples 1-7: SPA-ST-1,2,3,4,5,6,7], collected randomly from the
following locations, respectively: relaxation lounge (RL) ceiling south near light
rope, oxygen lounge (OL) south above fireplace, massage room (MR) 2 west
ceiling center, hallway convergence ceiling near lounge and NE corridor
doorways, RL north ceiling near light rope, MR 15 ceiling west center and west
spa rooms corridor ceiling above massage room 7. This surfacing material/texture
is on nearly all ceilings of the spa and walls of the corridors. The estimated impact
area of 5D is more than 5,000 sf, requiring a minimum of at least seven
surfacing/texture material samples. The PLM analytical estimated results: NONE
DETECTED. Nonfriable. Undamaged, except for the lounge ceiling where a prior
leak had occurred.
2. Spa Taped Drywall System, a homogeneous taped and joint compounded
drywall system (classified as a miscellaneous material as a complete integral
system) [samples 8-9: SPA-J-1,2], collected from the RL NW ceiling corner near
light rope and OL SE ceiling corner near light rope, respectively. These composite
layered taped and joint compounded drywall materials are on ceilings and walls of
the spa. The PLM analytical estimated results: NONE DETECTED. Nonfriable.
Undamaged.
3. Dark Brown OL Wallpaper, a homogeneous miscellaneous material requiring a
minimum of at least two samples [samples 10-11: LNG-WP-1,2], collected from
the SE inside corner behind doorframe and south wall near west side of fireplace,
respectively. The PLM analytical estimated results: NONE DETECTED. Non-
friable. Undamaged.
4. Silver OL Wallpaper, a homogeneous miscellaneous material requiring a
minimum of at least two samples [samples 12-13: LNG-WP 2-1,2], collected from
the OL SE corner above baseboard behind doorframe and east side of fireplace
above baseboard, respectively. The PLM analytical estimated results: NONE
DETECTED. Non-friable. Undamaged.
5. Brown RL Wallpaper, a homogeneous miscellaneous material requiring a
minimum of at least two samples [samples 14-15: RLX-WP-1,2], collected from
the RL SE corner above baseboard near doorframe and RL SW inside corner,
respectively. The PLM analytical estimated results: NONE DETECTED. Non-
friable. Undamaged.

6. Carpet Adhesive, a homogeneous miscellaneous material requiring a minimum
of at least two samples [samples 16-17: CRPT-ADH-1,2], collected from the RL
SE doorway and west MR corridor/RL carpet transition, respectively. The PLM
analytical estimated results: NONE DETECTED. Non-friable. Undamaged.
7. Hallway Tile Grout, a homogeneous miscellaneous material requiring a
minimum of at least two samples [samples 18-19: SPA-HLTG-1,2], collected
from the north reception/corridor doorway and east reception/corridor doorway,
respectively. The PLM analytical estimated results: NONE DETECTED. Non-
friable. Undamaged.
8. Flat Finish Surfacing Texture, a homogeneous trowel-applied surfacing
material/texture [samples 20-26: FF-1,2,3,4,5,6,7], collected randomly from the
NW wall near stone feature at end of corridor to RL, east MR corridor end near
exit door, employee kitchen south wall near trash cans, reception area east of
women’s locker doorway, behind trash can in hallway north of reception area,
below fire extinguisher in MR west corridor and north wall at end of NW hallway
to power room. This surfacing material/texture is on various corridor, store and
reception walls. The estimated impact area of 5D is more than 5,000 sf requiring a
minimum of at least seven surfacing/texture material samples. The PLM
analytical estimated results: NONE DETECTED. Nonfriable. Undamaged.
9. Common & Reception Area Plaster Surfacing Material, a homogeneous
trowel-applied surfacing material/texture [samples 27-31: PL-1,2,3,4,5], collected
randomly from hallway ceiling above entrance to RL, hallway ceiling outside of
nail salon, reception ceiling south, reception ceiling west and reception ceiling
north. This surfacing material/texture is on ceilings of the round reception room
and adjoining corridor ceilings. The estimated impact area of 5D is more than
1,000 sf, but less than 5,000 sf (± 2500 sf), requiring a minimum of at least five
surfacing/texture material samples. The PLM analytical estimated results: NONE
DETECTED. Nonfriable. Undamaged.
10. Store Gray Plaster Surfacing Material, a homogeneous trowel-applied
surfacing material/texture [samples 32-34: STOR-PL-1,2,3], collected randomly
from store north wall east of doorway, west wall middle below outlet and east
wall near outlet. This surfacing material/texture is on walls of the store. The
estimated impact area of 5D is more than 100 sf, but less than 3,000 sf (± 1500
sf), requiring a minimum of at least three surfacing/texture material samples. The
PLM analytical estimated results: NONE DETECTED. Nonfriable. Undamaged.
11. Store Vinyl Plank, a homogeneous miscellaneous material requiring a minimum
of at least two samples [samples 35-36: STOR-VP-1,2], collected from the west
and east sides of the doorway to the reception, respectively. The PLM analytical
estimated results: NONE DETECTED. Non-friable. Undamaged.
12. Massage Rooms Sheet Vinyl Flooring, a homogeneous miscellaneous material
requiring a minimum of at least two samples [samples 37-38: MSG-SV-1,2],
collected from the MR 2 SW corner and MR 8 behind door, respectively. The
PLM analytical estimated results: NONE DETECTED. Non-friable. Undamaged.
13. Massage Rooms Wallpaper, a homogeneous miscellaneous material requiring a
minimum of at least two samples [samples 39-40: MSG-WP-1,2], collected from

14. Massage Rooms Ceiling Tiles, a homogeneous miscellaneous gypsum-based

CT-1,2], collected from the MR 2 and MR 13 ceilings near west walls,
respectively. The PLM analytical estimated results: NONE DETECTED. Friable.

15. Employee Kitchen-Break Room Ceiling Tiles, a homogeneous miscellaneous
material requiring a minimum of at least two samples [samples 43-44: BRK-CT-
1,2], collected from the south and north ceiling areas, respectively. The PLM

16. Office Carpet Adhesive, a homogeneous miscellaneous material requiring a

17. Nail Salon & Men’s Locker Room Basket Weave Sheet Vinyl Flooring, a
homogeneous miscellaneous material requiring a minimum of at least two
samples [samples 47-48: SPA-BW-V-1,2], collected from the nail salon NW and
SW corners, respectively. The PLM analytical estimated results: NONE
DETECTED. Non-friable. Undamaged.
18. Nail Salon Wallpaper, a homogeneous miscellaneous material requiring a
minimum of at least two samples [samples 49-50: SPA-NS-WP-1,2], collected
from the east side of entry doorway above baseboard and SE corner behind door,
respectively. The PLM analytical estimated results: NONE DETECTED. Non-
friable. Undamaged.
A total of 50 suspect homogeneous ACM/ACBM bulk samples were collected and 50
samples were analyzed. The bulk samples were analyzed by EPA 600 PLM analytical
methods by a NVLAP accredited laboratory in accordance with Colorado State
Regulation 8 for the presence of asbestos mineral fibers. There is NO asbestos in all 50
samples.

HEALTHSAFE CONCLUSIONS
• There is NO asbestos in any of the suspect building materials slated for 5D in the
spa area renovation. NO asbestos abatement will be required for any of the
building materials. All building waste and debris can be disposed of in any landfill
which accepts normal, non-hazardous building waste.

COLORADO & FEDERAL ASBESTOS REGULATIONS SUMMARY
Regulation No. 8 Part B – Asbestos of the Colorado Department of Public Health and
Environment (CDPHE), Air Quality Control Commission requires a State-certified
Asbestos Building Inspector to inspect and collect bulk samples of all suspect asbestos
containing materials (ACM) or suspect asbestos containing building materials (ACBM)
prior to their disturbance, removal or demolition and disposal. The suspect materials shall
be analyzed by a NVLAP accredited laboratory by polarized light microscopy (PLM)
using EPA 600 analytical method. A material which is estimated to contain more than 1%
asbestos is classified as ACM/ACBM and regulated by the State and Federal
governments. Any friable (able to crush or reduce to powder by finger pressure) asbestos
with trace amounts of asbestos fibers or less than 1% must be point-counted using EPA
400 analytical method to prove that it is indeed less than 1%; if not, it must be classified
as ACM/ACBM and shall be treated as a State and Federal regulated material. Any
friable asbestos containing material (greater than 1% asbestos concentration) or
ACM/ACBM that could be rendered friable during its removal or demolition and disposal
shall require an asbestos abatement by a certified asbestos abatement contractor to
remove and dispose of the material(s).
A Colorado State (CDPHE) issued asbestos abatement permit is required for the
following trigger levels of ACM/ACBM:
1. Residential buildings of four or fewer units--if more than 32 square feet of any
surface coverage (e.g., gypsum wallboard or drywall and associated applied surfacing
materials/textures, acoustic sprays, joint compounds, plaster, etc.), 50 feet of asbestos
covered or asbestos insulated pipe or any material which would fill a 55-gallon drum is
going to be disturbed, removed or disposed of, an asbestos abatement permit is required.
2. Residential complexes with more than four residential units, public access areas to a
residential building, commercial and retail buildings, public and civic buildings,
industrial buildings--if more than 160 square feet of surfacing materials, 260 linear feet
or more than 35 cubic feet (NESHAP) or 55-gallon drum (CDPHE) of suspect
ACM/ACBM is going to be disturbed, removed or disposed of, an asbestos abatement
permit is required under NESHAP and by the CDPHE. See note below on OSHA.
The regulations require an absolute minimum of 3 samples (EPA suggests 9) per
homogenous suspect surfacing and TSI materials and an absolute minimum of 2 samples
of homogenous miscellaneous materials or any number of “samples sufficient to
determine whether a material is ACM” (Reg8.IV.D.3). More samples are required based
on surface area or volume. These are minimums; the asbestos building inspector has the
field responsibility to determine homogenous materials and the number of samples to
collect per material; more than the minimum number of samples may be necessary at the

discretion of the inspector. An assessment of friability and functional space conditions of
the materials are also the inspector’s field responsibilities.
OSHA compliance is required for all employers and employees no matter the
quantity of asbestos present with strict regulations regarding 10 sf or more of TSI or
friable surfacing materials, and therefore it does not matter what the quantity or
State trigger levels are: all suspect ACM/ACBM shall be inspected and tested for
asbestos prior to their disturbance, removal and disposal for worker protection and
safety. See EPA 40 CFR 763.121 Worker Protection Rule, OSHA 29 CFR 1910.134
Respirator Protection Standard, OSHA 29 CFR 1910.1001 General Industry Standard and
OSHA 29 CFR 1926.1101 Construction Standard regulations when dealing with asbestos
hazards.
