AGREEMENT
Agreement for Right-of-Way Restoration at 920 W. Hallam Street
(Lot B, Aspen Historic Cottages, Historic Lot Split)
By and between Aspen Historic Cottages LLC, as owner of the subject property, and
Nick Adeh, Aspen City Engineer, on this 19th day of May, 1999, regarding the time to
restore the public right-of-way fronting 920 W. Hallam Street with respect to the building
permit 9-065, issued to David & Amy Guthrie.
Aspen Historic Cottages LLC agrees to eliminate the existing driveway curb cut off of
920 W. Hallam St. (Highway 82), install a new curb & gutter to match the adjacent curbs
& gutter, restore the portion of the public right-of-way in-front of and adjoining the
driveway into the Lot B, Aspen Historic Cottages Lot Split, and create a crusher-fines
path along the W. Hallam St. frontage within one year of the date of issuance of a
building permit to remodel the historic house at 920 W. Hallam Street. The path will
remain in place until it is determined what changes are to be made to this area of W.
Hallam St. (Highway 82) as part of the "Entrance to Aspen" and the City asks the
property owners to complete the obligations of the "Sidewalk, Curb, and Gutter
Agreement" and/or the "Public Improvements Agreement" recorded separately with the
Pitkin County Clerk & Recorder.
This time extension for restoration of the public right-of-way is granted by the City
Engineer in consideration that additional utilities may need to be extended into Lot B
from W. Hallam St. in the near future: therefore it would be wasteful for the property
owner to disturb the restored right-of-way to install these new utilities, and would cause
additional traffic congestion in a major transportation corridor. Typically the property
owner must complete all work in and restoration of the public right-of-way fronting the
property being improved under a building permit prior to the issuance of a Certificate of
Occupancy for the property. Once the new utilities are installed from W. Hallam St. into
the property, the right-of-way will be restored as described above or in compliance with
future conditions of approval, or future City standards applicable to this portion of public
right-of-way, as determined by the City Engineer. Once the driveway is provided from
the alley into the property for parking at the Guthrie Residence, the existing driveway
onto W. Hallam St. will not be used for access or parking at the Guthrie Residence and
will be made inaccessible for vehicle parking.
This agreement runs with the land and is binding upon the owner, his assigns, heirs, and
subsequent owners, whether owners in part or whole of this property, being Lot B, Aspen
Historic Cottages Lot Split.
