PLAN FOR ccLC PUBLIC ART PROGRAM
MISSION:
The CCLC Public Art Program has been initiated with the purpose of commissioning
site specific art projects in the commercial core of the City of Aspen. The projects will be
temporary and rotating, with the possibility of evolving to more permanent installations
with larger budgets.
The goal is to bring vitality to the comntercial core by incorporating creative and
sometimes surprising works of art.
ARTS PROGRAM GOALS:
1. To involve artists in the selection of sites for projects:
2. To support outstanding artists of the Roaring Fork Valley and Colorado by
providing public exposure to their work, but not to exclude artists of national reputation;
3. To commission artists to create works which are responsive to the Aspen area and
it's unique characteristics;
4. To inform and educate Aspen residents and visitors about the Art Program, and to
provide opportunities for Aspen residents' to identify with the art works; and
5. To respect the public nature of the Art Program by assuring that it's administration
is open, fair and professional.
PUBLIC INFORMATION AND COMMUNITY RELATIONS:
Public information and education activities are considered primary elements of the
program.
One of the primary objectives will be to provide enhanced exposure to the artists of the
region involved in the program. Activities may include conferences, symposia, tours, and
cooperative programs with educationai and arts institutions.

Replacements or additions to this selection committee shall be nominated by the
existing selection committee, with the approval of the CCLC and ASCA. ASCA will be
the artistic, and CCLC will be the operational.
B. Responsibilities ofselectiun committee:
I. Ensure adherence to the goals of this plan and ro provide the highest standard of
aesthetics and continuity to the CCLC Public Art Program;
2. Evaluate recommendations for artists selections and to commission proposals and
submit to the CCLC;
3. ASCA shall in conjunction with CCLC staff representative create and distribute
basic guidelines for materials and security.
C. Composition Selection:
The makeup of the selection committee shall be at least 5 and not more than 7 people,
representing CCLC, ASCA, Parks Department, AA/Anderson.ranch, Red Brick, artists,
and community gallery owners.
All members of the Planning Committee and the Selection Committees shall serve
without compensation.
SELECTION OF SITES FOR ART INSTALLATION:
Sites for installation shall be rather broad and flexible, allowing the selected artists to
analyze and select the most appropriate approach in a particular area, rather than forcing
art into a predetermined space.
Artists who are selected for any of the sites shall work with the Parks Department
regarding installation requirements.

CHANGING SITE-SPECIFIC PROJECTS:
Art work Will be temporary and will be rotated every year or two years, depending upon
the budget of the program and the condition of the works. The Selection Committee shall
have the discretion for selecting art works for rotation, and their selections
recommendation shall be submitted to the CCLC committee for final approval. Changing
site-specific projects will provide vitality, variety and continuing opportunities for artists.
The progran~ is intended as an ongoing creative exploration of the City's environment by
artists, and it is expected that from time to time permanent commissions will be
developed from the most successful projects. Commissions for more permanent
installations will be considered after two years, depending upon the success of the
projects of limited duration. All projects shall be reviewed based upon their
compatibility with it's surrounding area and function.
COMMITTEES:
A. Selection Committees:
As individual projects are identified the planning committee will appoint ad-hoc
selection committees to evaluate artists' work and determine selected works.
B. Rational:
The ad-hoc selection committee will provide diversity and a continous fresh
perspective by allowing many individuals to be involved in the recommendation process.
ART WORK SELECTION:
A. Orientation:
Review committee orientation shall include: review of the CCLC and ASCA Art Plan
goals and processes, artists selections to date and focus of the particular project within
the overall program, tour of the proposed sites, review the project timetable, proposed
budget and artists selection process.
B. Selection Process:
1. All commissions shall be awarded through an open competition.
2. The first tier of artists shall be selected through the review of slides of the existing
artists' work. Proposals for the site will not be requested or considered at this time. A
maximum of three artists will be invited to submit proposals for specific commissions.

3. Review of Specific Proposals:
The Selection Committee shall evaluate the proposal submissions and shall
recommend up to three artists or teams for each project and shall submit their
recommendation in order of preference to the steering committee. Such evaluation shall
include a review of technical feasibility and maintenance acceptability.
CONFIDENTIALITY:
All meetings at which artists materials are reviewed and opinions ventured about their
merits in relation to the project at hand shall be closed to the public and media to permit
frank evaluation and discussion. A written report shall document the committee
discussions and recommendations.
CONFLICT OF INTEREST:
Artists serving as committee members may not be selected for direct involvement.
The planning committee will make every attempt to have impartial review panelists.
Conflict of interest will be signed by all panelists.
CONTRACTS:
Individual contracts between selected artists and the CCLC shall be executed before
any work on the site is conducted.
INSURANCE:
Insurance for liability as well as theft and damage shall be provided by the City of
Aspen.
CARE AND MAINTENANCE:
P~outine maintenance shall be provided by the City. If substantial repair is required for
an object, the Selection committee shall recommend a solutiOn to the CCLC.
DOCUMENTS:
The artists shall be responsible for submitting documentation of each work to the
planning committee.
FUNDING AND BUDGET:
The initial Budget iS $5,000. These funds shall be used as follows:
$500 administration and advertising
$250. to ASCA and $250. to Clerk's office
$4,500 for artists.
Additional funding shall be sought from individuals and corporate sponsors.

CARETAKERS; LODGES
RE: Required Snow and Ice Removal from sidewalks.
SECTION 21 OF THE ASPEN MUNICIPAL CODE
Every person in charge or control of any building or lot of land within the
city fronting or abutting a sidewalk area, whether as owner, tenant,
occupant, lessee, or otherwise, shall remove and clear away, or causes to be
removed and cleared away, snow and ice from a path of at least five (5) feet
in width from so much of the sidewalk area as is in front of or abuts on said
building or lot of land.
Such snow and ice shall be removed from all sidewalk areas within the city
on the same day as cessation of any fall of snow, sleet, or freezing rain or
within the first three (3) hours of daylight after the cessation of any such
fall, whichever period is longer.
No person shall deposit or cause to be deposited any snow and ice on or
against a fire hydrant or on any sidewalk, sidewalk area, roadway or loading
and unloading area of a public transportation system.

LICENSE AGREEMENT FOR USE OF CITY OF ASPEN ON:STREET
This agreement made and entered on the date hereinaiter stated, between the City
of Aspen, Colorado, ("City") and JAY'S VALET PARKING SERVICE ("Licensee").
For and in consideration of the mutual covenants conta'med herein, the parties
agree as follows:
1. ~ Licensee shall be entitled to use in a manner consistent
with the Scope of License as set forth at Exhibit "A' attached hereto and by this reference
incorporated herein.
2. l~IoI~lOlabJlJP~ Both parties recognize that this license cannot be
transferred, assigned, or sublet by either party without prior written consent of the other.
Sub-contracting, if authorized, shall not relieve the Licensee of any of/he responsibilities
or obligations under this agreement. Licensee shall be and remain solely responsible to the
City for the acts, errors, omissions or neglect of any subcontractors officers, agents and
employees, each of whom shall, for this purpose be deemed t0 be an agent or employee of
the Licensee to the extent of the subcontract. The city shall not be obligated to pay or be
liable for payment of any sums due which may be due to any sub- contractor.
3. ~ The Licensee or the city may terminate this Agreement,
without specifying the reason therefore, by giving notice, in writing, addressed to the other
party specifying the effective date of termination.
4. i:fl~apll:l,v~ag~ It is expressly acknowledged and understood by the
parties that nothing contained in this agreement shall result in, or be construed as
establishing an employment relationship. No agent, employee, or servant of Licensee shall
be, or shall be deemed to be, the employee, agent or servant of the City.
5. Indemnification. Licensee agrees to indemnify and hold harmless the
City, its officers, employees, insurers, and self-insurance pool, from and against all
liability, claims and demands, on account of injury, loss, or damage, including without
limitation claims arising from bodily injury, personal injury, sickness, disease, death,
property loss or damage, or any other loss of any kind whatsoever, which arise out of or
are in manner connected with this contract, if such injury, loss, or damage is caused in
whole or in part by, or is claimed to be caused in whole or in part by the act, omission,
error, professional error, mistake, negligence or other fault of the Licensee, any
subcontractor of the Licensee, or any officer, employee, representative, or agent of the
Licensee or of any subcontractor of the Licensee, or which arises out of any workmen's
compensation claim of any employee of the Licensee or of any employee of any
subcontractor of the Licensee. The LiCensee agrees to investigate, handle, respond to, and
to provide defense for and defend against, any such liability, claims or demands at the sole
to provide defense for and defend against, any such liability, claims or demands at the sole
expense of the Licensee, or at the option of the City, agrees to pay the City or reimburse
the City for the defense costs incurred by the City m connection with, any such liability,
claims, or demands. The Licensee also agrees to bear all other costs and expenses related
thereto, including court costs and attorney fees, whether or not any such liability, claims,
or demands alleged are groundless, false, or fraudulent. If it is detem~ined by the final
judgment ora court of competent jurisdiction that such injury, loss, or damage was caused
in whole or in part by the act, omission, or other fault of the City, its officers, or its
employees, the city shall reimburse the Licensee for the portion of the judgment
attributable to such act, omission, or other fault of the City, its officers, or employees.
6. Licensee's Insurance. (a) Licensee agrees to procure and maintain, at its
own expense, a policy or policies of insurance sufficient to insure against all liability,
claims, demands, and other obligations assumed by the Licensee pursuant to Section 8
above. Such insurance shall be in addition to any other insurance requirements imposed
by this contract or by law. The Licensee shall not be relieved of any habitity, claims,
demands, or other obligations assumed pursuant to Section 8 above reason of its failure to
procure or maintain insurance, or by reason of its failure to procure or maintain insurance
in sufficient amounts, duration, or types.

7. City's Insurance. The parties hereto understand that the City is a member
of the Colorado Intergovernmental Risk Sharing Agency (CIRSA) and such participates in
the CIRSA Property/Casualty Pool. Copies of the CIRSA policies and manual are kept at
the City of Aspen Finance Department and are available to Licensee for inspection during
normal business hours. City makes no representations whatsoever with respect to specific
coverages offered by CIRSA. City shall provide Licensee reasonable notice of any changes
in its membership or participation in CIRSA.
8. Completeness of Agreement. It is expressly agreed that this agreement
contains the entire undertaken of the parties relevant to the subject matter thereof and
there are no verbal or written representations, agreements, warranties or promi.ses
pertaining to the project matter thereof not expressly incorporated in this writing.
9. Notice. Any written notices as called for herein may be hand delivered to
the respective persons and/or addresses listed below or mailed by certified mail return
receipt requested, to:

10. Non-Discrimination; penalty. No discrimination because of race, color,
creed, sex marital status, affectional or sexual orientation, family responsibility, national
origin, ancestry, handicap, or religion shall be rm/de in the employment of persons to
perform services under this contract. Licensee agrees to meet all of the requirements of
City's municipal code, Section 13-98, pertaining to non-discrimination in employment.
11. Waiver. The waiver by the City of any term. covenant, or condition hereof
shall not operate as a waiver of any subsequent breach of the same or any other tenn. No
Term, covenant, or condition to be performed by Licensee to which the same may apply
and, until complete performance by Licensee of said term, covenant or condition, the City
shall be entitled to invoke any remedy ava'dable to it under this Agreement or by law
despite any such forbearance or indulgence.
12. General Terms.
(a) It is agreed that neither this agreement nor any of its terms,
provisions, conditions, representations or covenants can be modified, changed, terminated
or amended, waived, superseded or extended except by appropriate written instrument full
executed by the parties.
(b) If any of the provision of this agreement shall be held invalid, illegal
or unenforceable it shall not affect or impair the validity, legality or enforceability of any
other provision.
(c) The parties acknowledge and understand that there are no
conditions or limitations to this understanding except those as contained herein at the
same time of the execution hereof and that after execution no alteration, change or
modification shall be made except upon a writing signed by parties.
(d) This agreement shall be governed by the laws of the State of
Colorado as from time to time in effect.
IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by
their duly authorized officials, this Agreement in three copies each of which shall be
deemed an original on the date hereinafter written.

Scope of License
November 1997
TERMS AND CONDITIONS:
1. The City of Aspen Will Provide a maximum of six (6) parking spaces to be used
for the staging of cars, for valet parking, between the hours of 6:00p.m. and
2:00a.m. seven days a week.
2. Those spaces will be designated by the Parking Operations Manger on
the south side of the 400 Block of East Hopkins. The City may requests
changes in the location of, and/or type of parking (angle vs. parallel) with, the
spaces provided for valet staging.
3. The spaces will only be designated with singe either provided by the
City and explicitly approved in writing by the City.
4. No double parking will be allowed at any time~
5. Additional equipment or signage placed on the sidewalk, curb, or street
will need prior written consent fi°om the City. Any such approved equipment or
signage will be at Jay's Valet expense.
6. Vehicles will be staged adequately and safely, utilizing the designated
staging spaces, without congesting the surrounding area and leaving the
intersection and streets clear at all times.
7. Vehicles will be staged in the area for a minimum amount of time
necessary for customer loading and unloading, not to exceed five minutes per
vehicle.
8. All vehicles using Jay's Valet service will be parked in the Rio Grande
Parking Plaza. Under no circumstances will Vehicles be parked elsewhere.
9. Jay's Valet employees will be encouraged to carpool or to utilize
RFTA trm~sit service. All vehicles remaining in the Rio Grande Parking
Plaza after the attendant goes off-duty receive an After-Hours payment
notice, requiring garage fees to be paid. Under no circumstances are
valet employees to park their own vehicles in the valet staging area.
I0. Jay's Valet employees will continue to use discretion with regard to
intoxicated drivers. Tipsy Taxi will be called and the car will remain in
the garage until the following day for intoxicated drivers.
11. In keeping with the fee structure for the Rio Grande Parking Plaza
($0.75gar.), Jay's Valet will be charged $2.00 for the equivalent of two (2)
hours parking per vehicle valet parked. Parking fees will be paid to the
City of Aspen monthly by the fiRh day of each month for the previous month.
Parking garage procedures include the following:
a, All valet drivers will place valet stub on the rearview mirror,
and back vehicles into perpendicular parking spaces.
b. All valet drivers must use the parking garage pass cards upon
entering and exiting the parking garage. If gates are raised
or broken, valet drivers must insert card into card reader so
accurate accounting may be kept by the City staff.. The number
of exits and entrances must match each other on a nightly basis.
c. All pass cards must be returned at the end of the season.
Replacement cards will be issued at a cost orS10.00.
12. Valet service will be provided at no charge for handicapped individuals.
13. The valet staging area will be available for short-term taxi staging.
14. A designated valet service supervisor will be on call at all times to
ensure full compliance with correct operating procedures and conditions.
15. Jay's Valet will carry liability insurance in the mount specified in Section 6 of
this License Agreement. City reserves the right to review and modify
insurance requirements.
16. At Least two (2) weeks prior to the beginning of the service, Jay's Valet
will provide to the City Parking Operations Manager director a copy of the
following:
* Service specifications and operations plan including hours of
operation rates, drop off and pick up arrangements, etc.
* Jay'sValet service manager(s) name(s) and phone number(s) to
allow contact at any t/me during valet sermce hours.
* Certificate of insurance, demonstrating adequate general liability
and garage keepers insurance coverage.
* Sample of daily/monthly report formats.
· 17. Jay's Valet will maintain accurate and complete records for the valet service.
The City reserves the right to audit such record at any time.
18. Monthly reports will be submitted to the City Parking Operations
Manager by the fifth day of each month for the preceding month's valet
service activity., Additionally payment to the City for the previous month's
fees will be paid at this time,
19. The City will enforce the valet staging area parking regulations through the
issuance of parking tickets. Vehicles will only be towed at the discretion of
the Police Department,
20. Jay's Valet will communicate any problems or requests to the City through the
Parking Operations Manager.
21. In the best interest of the City of Aspen, the City reserves the right to review
and modify any of these terms and conditions.
