A RESOLUTION OF THE CITY COUNCIL OF THE CITy OF ASPEN
APPROVING THE ~CO~f;iMENDX~0NS AND PRELIMINARY SKETCH
SITE PLAN AS RECOMMENDED By THE BU~INGAME PARCEL D
COWOP TASK FORCE TEAM

WHEREAS, the Community Development Department received an application
from the Asset Management Department for an affordable housing development on
property located on Ventnor Avenue in the Aspen Airport Business Center, commonly
referred to as Burlingame Parcel D, to be reviewed and processed as a project Reasonably
Necessary for the Convenience and Welfare of the Public (COWOP) pursuant to Section
26.500.010 of the Aspen Municipal Code; and,
WHEREAS, pursuant to Section 26.304.060(C) of the Aspen Municipal Code,
the City Council adopted Resolution No. 89, Series of 2002, which found the Burlingame
Parcel D project to be eligible as a COWOP project and which established the
Burlingame Parcel D COWOP Task Force ~eam with specific responsibility to develop
and recommend a Preliminary Sketch Site Plan to the City Council; and,
WHEREAS, the Burlingan~e Parcel D COWOP Task FOrce Team conducted
three legally noticed public meetings where deliberations regarding the preparation of the
site plan were conducted and the public was provided an opportmfity to provide comment
regarding the project; and,
WHEREAS, the Burlingame Parcel D COWOP Task Force Team concluded their
deliberations on November 14, 2002, and by unanimous vote approved a Preliminary
Sketch Site Plan (dated November 12, 2002) and a recommendation conta/ned within a
memorandum from the COWOP Task Force Team, dated November 14, 2002, and these
documents were provided to the City Council at their meeting on Nove~nber 25, 2002; and,
WHEREAS, the City Council reviewed, evaluated and found that the Preliminary
Sketch Site Plan and recommendation of the COWOP Task Force Team address the
development issues of the site, including '~b_reshold Physical Planning Issues" and "Other
Issues to be Addressed in the Next Planning & Approval Stages" that will be beneficial to
and guide the further plmming and development of Burlingame Parcel D for an affordable
housing project; and,
WHEREAS, during a public meeting on November 25, 2002, the City Council,
approved of the Preliminary Sketch Site Plan and the recommendations of the
Burlingame COWOP Task Force Team by a vote of four to zero (4-0).

WHEREAS, the City Council finds that this Resolution furthers and is necessary
for the promotion of public health, safety, and welfare; and,
NOW, THEREFORE' BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN,
COLORADO, THAT:
Section 1:
The Aspen City Council does hereby approve of the Preliminary Sketch Site Plan, dated
November 12, 2002, to be utilized as a guide in the further planning and development of
the Burlingame Parcel D Affordable Housing project.
Section 2:
The Aspen City Council does hereby acknowledge and adopt the following physical
planning parameters which shall guide the further plam~ing of the development of the
Burlingame Parcel D Affordable Housing project.
Physical Planning Parameters:
1. Respond to the hillside topography and reduce the apparent mass of the buildings
while improving views and solar benefits by following the existing contours
rather than leveling the entire building area.
2. Cluster the development into groups of units to minimize sprawl on the site,
minimize environmental impacts, maximize investment on foundations & roads,
and keep overall costs down and to preserve open space.
3. Take advantage of topography of the site to include under-structure parking,
rather than all surface parking.
4.Provide enough parking but do not over park the site.
5. The only vehicular access point should be from Ventnor Drive and utilize existing
roadways rather than create any new access points to Highway 82. The new
intersection should consider and mitigate the impact of a significant number of
new peak hour vehicle trips onto an already crowded and narrow Ventnor Drive.
6. Respond to the maximum heights of buildings in the adjacent AABC and consider
a.) impacts on existing views, and b.) visibility of the buildings from Highway 82
when siting buildings.
7.Take advantage o f mountain views and solar access in orienting buildings.
8. To avoid sprawl and visual impacts on Highway 82, the portion of the property
fronting on the highway should be left undeveloped and preserved as open space
through the conveyance of a conservation easement to an appropriate land
conservation organization.
9. Orient buildings to take advantage of the Deer Hill open space, allowing for a feel
of"backyard" accessibility and views of the open space.
10. A safe and accessible pedestrian and bike trail should be provided from the
project to the existing trail network as a part of the development rather than rely
on existing AABC streets.

The Aspen City Council does hereby acknowledge and adopt the following
recorrm~endations identified by the COWOP Task Force Team as issues which shall be
addressed in the future planning and development of the Burlingame Parcel D Affordable
Housing project.
Development Issues to be Addressed in the Next Planning & Approval Stages:
1. Implement "green development", in terms of materials, techniques and landscape
preservation.
2. Provide a minimum of 1.75 parking spaces and a maximum of up to 2 spaces per
unit. Overflow parking areas may be located separate from the main parking
areas and have a different surface. Two car-sharing parking spaces should be
provided.
3. Two-story buildings are preferable and designers are strongly encouraged to work
within that constraint, but three-story buildings are not precluded if necessary in
the overall scheme of the development.
4. Handicap accessibility should be an important factor in determining the final
design of the building type, layout and site plan. The design should be compliant
with or exceed all applicable codes regarding accessibility and such features
should be fully integrated throughout the facility to allow easy and common
access for all residents.
5. Mitigate for traffic impacts generated by the development,
6. Select building colors and materials that allow the development to blend into the
natural setting and retain compatibility with the surrounding AABC environment
7. Mitigate, to the extent needed, the noise and visual impacts of the neighboring
commercial/industrial properties on the new residential development through
landscaping, landforms, and up~aded fences. Work with the adjacent owners to
change operating procedures, but do not rely on them changing their business
operations to provide a suitable residential environment. The legal covenants for
the development should include provisions that obligate the owners to accept, and
not legally remonstrate against, the existing level of operating impacts (noise,
vibration, etc.) from neighboring businesses.
8. Implement best practices of construction management to minimize dust, refuse,
parking conflict and safety.
9. Minimize the impacts of dogs on the wildlife in the area, yet develop a plan that
would allow homeowners to have pets.
10. Allow for minimal exterior lighting but ensure adequacy to provide for safe
movement of pedestrians and motorists.
11. Final design should address storm water runoff and wildfire mitigation.
12. Buildings must be compliant with ADA regulations.
l 3. Provide, at a minimum, sidewalks along the roadways, bike racks, and car share
parking spaces, to encourage options to vehicular travel and the use of transit.
14. Investigate the opportunity for and implement a trail between Burlingame Parcel
D and Burlingarne with appropriate connections to existing public trails.
15. Evaluate emergency access options through BMC and Planted Earth, if necessary.

Section 4:
This Resolution shall not effect any existing litigation and shall not operate as an
abatement of any action or proceeding now pending under or by virtue of the ordirmnces
repealed or mnended as herein provided, and the same shall be conducted and concluded
under such prior ordinances.
Section 5:
If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for
any reason held invalid or tmconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent provision and shall not affect
the validity of the remaining portions thereof,
