A brick paved and landscaped courtyard separates the existing buildings. Proposed Condominiumization The applicant proposes to subdivide Unit 1 into Units 1-A and 1-B pursuant to the provisions of the Colorado Common Interest Ownership Act, as amended. Unit 1-A will consist of approximately 5,005 square feet of land area and will contain the one (1) story addition and the brick - paved landscaped courtyard.. Unit 1-B will consist of approximately 2,844 square feet of land area and will contain the two (2) story apartment building. Review Requirements Pursuant to Section 26.88.030.3 of the Regulations, the conversion of existing development to condominium ownership pursuant to the standards and procedures of section 26.88.070 of the Regulations is exempted from the rules otherwise applicable to subdivision of land under Chapter 26.88. Section 26.88.070 of the Regulations provides that where an existing development is to be converted to a condominium form of ownership, a condominium subdivision exemption plat reflecting all condominiumized units, or that portion of the development to be condominiumized, shall be submitted to the planning director for review and approval as a subdivision exemption. Section 26.88.070B provides that a development application for a condominiumization shall be reviewed pursuant to the procedures and standards of Section 26.88.070 and Common Procedures, Chapter 26.52. Section 26.88.070B.1 provides that the contents of a development application for a condominiumization shall include: (a) the general application information required in Section 26.52.030 of the Regulations; and (b) a condominium subdivision exemption plat which includes the requirements of Section 26.88.070B.1.b.(1)-(9). The general application information required by Section 26.52.030 of the Regulations is attached as Exhibit "C". A condominium subdivision exemption plat reflecting that portion of the development to be condominiumized and which includes the requirements of Section 26.88.070B.1.b.(1)-(9) of the Regulations is enclosed with this application. Also enclosed with this application is a copy of the old (existing) plat for The Galena Plaza Condominiums (per Pre -Application Conference Summary, item #6).
