Amended Condominium Plat
To the City of Aspen:
This letter summarizes the application for approval of an amended condominium plat for the
Roaring Fork Condominium Association. The Applicant is the Roaring Fork Condominium
Association, whose address is 415 E. Hyman Ave., Aspen, CO, 81611. This application is for the
building located at the same address.
A. Standards of Land Use Code
This proposal is intended to address certain minor technical discrepancies in the prior plats
for the building as well as to resolve certain ambiguities regarding general and limited common areas
which came to the attention of the owners of the building following the remodeling of the basement
area for the unit occupied by Club Chelsea. The proposal does not increase the size of the building,
make any changes to the structural components of the building, nor does it make any changes visible
from the outside of the structure. The Third Amended Plat does incorporate certain minor changes,
such as revisions to the entrance of the unit in the basement, which remodeling was completed under
proper permit when Chelsea was remodeled. Thus, the proposal has no growth or other impacts and
meets the standards for approval on the staff level including referral to the City Engineer. Unit 3 is
owned by Ryanco Partners Ltd., No. XVI while Unites I and 2 are owned by Dr. Bruce Carlson or
his company.
The changes from the prior plat include the conversion of some space from General Common
Elements from Limited Common Elements. For example, the landing at the bottom of the stairs
leading from the Mall to Club Chelsea in the basement is converted from a General Common Element
to a Limited Common Element, serving only Unit 3. Similarly, the stairs towards the rear of the
Basement, First and Second Floors are now Limited Common Elements.. Conversely, the stairway

leading from the Third to the Fourth Floor only is useful to Dr. Carlson, and thus will be a Limited
Common Element only for Units 2 and 3. These changes resulted from negotiations between the
owners of the property to reflect the reality that these elements served only particular units and were
not useful or necessary to the owners of units on other floors. Finally, minor discrepancies in the
depiction of the area occupied by mechanical elements and the elevator were corrected to show the
true location ofthese elements, and make same consistent between the various floors.
B. Submission Reauirements - Attachments
1. The deposit for the review of the application is submitted herewith.
2. Proof of ownership from Pitkin County Title is attached as Exhibit "A".
3. The letter from the Association authorizing the undersigned to process this application is
attached as Exhibit "8"
4. The vicinity map is attached as Exhibit "C".
5. The legal description of the property is attached as Exhibit "D".
6. The proposed language to be added for the definition of Limited Common Element is
attached as Exhibit "E".
7. The proposed and existing plats are being provided by the Registered Land Surveyor.
