Plat Amendment Application (Subdivision)
River Bluff Townhomes, 155 Lone Pine Road

Description of Application:
Pursuant to a 1989 land use approval, the River Bluff Townhomes were granted
the right to build additional square footage in each of the 12 townhome units.
This approval required the recordation of an amended plat to reflect the
expansions. As of 1991, this recordation had not been completed and was made
a condition of approval for the additional enlargement of Unit C-1. Despite this
re -requirement, it was recently discovered that a revised condo plat has never
been recorded to reflect the unit changes.
This application seeks to remedy this deficiency by recording a newly revised
condo plat, reflecting all changes made to the common areas of the
condominium buildings and other improvements on the parcel.
Responses to Review Criteria:
26.480.050. Administrative subdivisions.
A. Condom ini umizati on. A subdivision to establish, amend, or vacate separate ownership
interests of a single property in a Condominium or Common Ownership Interest Community
form of ownership shall be approved, approved with conditions, or denied by the Community
Development Director. Condominiumization shall be limited to allocating ownership interests of
a single parcel and shall not effect a division of the parcel into multiple lots, an aggregation of the
parcel with other lands, a change in use of the property, and shall not operate as an abatement of
other applicable regulations affecting the property. The Director shall review the
condom ini urn ization plat pursuant to Section 26.480.030, Procedures for Review, and according
to the following standards:
1. The Condominium Plat is in an acceptable style and format as prescribed in Title 29 -
Engineering Design Standards, Plats.
The submitted Condominium Plat is in the style and format as prescribed
in Title 29 - Engineering Design Standards, Plats. (checklist attached)
2. The Condominium Plat shall be reviewed and then recorded in the office of the Pitkin
County Clerk and Recorder. No subdivision agreement need be prepared or entered into
between the applicant and the City unless the Community Development Director determines
such an agreement is necessary.
The Condominium Plat is submitted for review through this application
and will be recorded subsequent to its acceptance.

DESCRIPTION: The Applicant is interested in filing an updated condominium plat for the River Bluffs
Townhomes at 155 Lone Pine Rd. to memorialize increases in floor area that were granted in the early 1990's.
These condominiums are located in the R/MF A Zone District, and are knows as Lot 2 of the Lone Pine
Condominiums. Development and redevelopment on this parcel is subject to Stream Margin Review.
Ordinance 34, Series of 1991 outlines a number of approvals, including the ability of the homeowners to enclose
second level roof decks and to increase unit C-1 by 833 sq. ft. This Ordinance also indicates that prior to the
parcel's annexation in to the City in 1989 the twelve free market Lone Pine Condominiums received approval by
the Pitkin County Planning Commission to expand the units by 118 sq ft which required the recording of a new
plat. The updated plat was never recorded. Prior to any new projects being approved for this subdivision, a new
plat will need to be recorded that accurately depicts the natural and man-made features on the property, in
accordance with Section 26.480.050.A of the Land Use Code.

Re: Ownership of Common Elements in River Bluff Townhome Condominiums (the
"Property").
Ladies and Gentlemen:
We represent River Bluff Townhome Association, Inc. (the "Association") in connection with
various matters related to the River Bluff Townhome Condominiums.' The Association is the
unit owners association of the River Bluff Townhome condominium project (the "Project"). The
Association asked us to investigate and report on the ownership and encumbrance of the Project's
Common Elements as shown in the records of the Pitkin County Clerk and Recorder (the
"County's Real Property Records") and as defined in relevant law of the State of Colorado. In
carrying out our investigation, we engaged Stewart Title -- Aspen to review the County's Real
Property Records to determine if any liens or other financial obligations encumber the Common
Elements. We have relied exclusively on the Written Ownership and Encumbrance Report of
Stewart Title -- Aspen which is attached hereto as Exhibit A in making the representations made
below concerning financial encumbrances which exist against the Common Elements.
Based on our review of the County's Real Property Records and relevant Colorado law,
ownership of the Common Elements is vested in the owners of Condominium Units as tenants in
common, subject to the rights of the Association to manage and protect the Common Elements,
as described in the Condominium Declaration and applicable sections of the Colorado Common
Interest Ownership Act and other relevant law. In particular, but not by way of limitation, the
Association has the right to "regulate the use, maintenance, repair, replacement, and modification

All Condominiums require a Condominium Plat Survey. The following are the minimum
requirements for a City of Aspen Condominium Plat Survey:
A final condominium plat survey shall be drawn with permanent ink on 3 or 4 millimeter
thick Mylar. Two copies are to be submitted for recordation.
el"Sheet size shall be 24 inches by 36 inches with a margin of 2 inches on the left hand side
and a'/s inch on the remaining three. Architectural scales are not permitted.
r�' Title of condominium plat survey shall be on the top center of front page in large letters
not less than 1 inch tall.

DESCRIPTION: The Applicant is interested in filing an updated condominium plat for the River Bluffs
Townhomes at 155 Lone Pine Rd. to memorialize increases in floor area that were granted in the early 1990's.
These condominiums are located in the R/MF A Zone District, and are knows as Lot 2 of the Lone Pine
Condominiums. Development and redevelopment on this parcel is subject to Stream Margin Review.
Ordinance 34, Series of 1991 outlines a number of approvals, including the ability of the homeowners to enclose
second level roof decks and to increase unit C-1 by 833 sq. ft. This Ordinance also indicates that prior to the
parcel's annexation in to the City in 1989 the twelve free market Lone Pine Condominiums received approval by
the Pitkin County Planning Commission to expand the units by 118 sq ft which required the recording of a new
plat. The updated plat was never recorded. Prior to any new projects being approved for this subdivision, a new
plat will need to be recorded that accurately depicts the natural and man-made features on the property, in
accordance with Section 26.480.050.A of the Land Use Code.

We represent River Bluff Townhome Association, Inc. (the "Association") in connection with
various matters related to the River Bluff Townhome Condominiums.' The Association is the
unit owners association of the River Bluff Townhome condominium project (the "Project"). The
Association asked us to investigate and report on the ownership and encumbrance of the Project's
Common Elements as shown in the records of the Pitkin County Clerk and Recorder (the
"County's Real Property Records") and as defined in relevant law of the State of Colorado. In
carrying out our investigation, we engaged Stewart Title -- Aspen to review the County's Real
Property Records to determine if any liens or other financial obligations encumber the Common
Elements. We have relied exclusively on the Written Ownership and Encumbrance Report of
Stewart Title -- Aspen which is attached hereto as Exhibit A in making the representations made
below concerning financial encumbrances which exist against the Common Elements.
Based on our review of the County's Real Property Records and relevant Colorado law,
ownership of the Common Elements is vested in the owners of Condominium Units as tenants in
common, subject to the rights of the Association to manage and protect the Common Elements,
as described in the Condominium Declaration and applicable sections of the Colorado Common
Interest Ownership Act and other relevant law. In particular, but not by way of limitation, the
Association has the right to "regulate the use, maintenance, repair, replacement, and modification
