(the "Association") in connection with various matters related to the River Bluff Townhome Condominiums.' The Association is the unit owners association of the River Bluff Townhome condominium project (the "Project"). The Association asked us to investigate and report on the ownership and encumbrance of the Project's Common Elements as shown in the records of the Pitkin County Clerk and Recorder (the "County's Real Property Records") and as defined in relevant law of the State of Colorado. Based on our review of the County's Real Property Records and relevant Colorado law, ownership of the Common Elements is vested in the owners of Condominium Units as tenants in common, subject to the rights of the Association to manage and protect the Common Elements, as described in the Condominium Declaration and applicable sections of the Colorado Common Interest Ownership Act and other relevant law.
