Main Street, Aspen, Pitkin County, Colorado, presently being operated under the trade name "Aspen Mountain Lodge" as a hotel providing overnight lodging to the general public on a short term basis for a fee, was recorded in the records of Pitkin County, Colorado, on January 9, 1984, at Book 458, Page 829, Reception No. 256314; WHEREAS, Section 35 of said Condominium Declaration provides that an owner's use of his (or her) unit in the project is restricted to not more than 14 days during the seasonal period of December 18 through March 20, and states that such restriction was imposed by the City of Aspen not to benefit Declarant but to continue a use deemed necessary to the City of Aspen; WHEREAS, said Section 35 further provides that if the City of Aspen amends portions of its Municipal Code such that the owners' use restriction embodied in said Section 35 is no longer required as a condition to approval for the condominiumization of a lodge, then said restriction shall be deemed to lapse and the Board of Directors of The Aspen Homeowners' Association shall be authorized to obtain from the City of Aspen and record a certificate which reflects that the property is released from such restriction; WHEREAS, the City of Aspen Municipal Code has been amended to change the owners' use restrictions applicable to The Aspen; specifically, the City of Aspen Land Use Code, in Section 26.104.100, under the definition of "Hotel", now provides that occupancy periods of a hotel or unit thereof by any one person or entity with an ownership interest in the hotel or units thereof shall not exceed thirty consecutive days or exceed ninety days within any calendar year; WHEREAS, the City of Aspen has been provided with documentation showing that the Members of The Aspen Homeowners' Association have voted to acknowledge and adopt an increase of the unit owners' permissible personal use of their units to the maximum owners' occupancy now permitted under the City of Aspen Land Use Code, and the Directors of the Association have resolved that action be taken to obtain a certificate from the City of Aspen confirming that The Aspen is released from the owners' use restriction stated in said Section 35 of the Declaration of not more than fourteen days during the seasonal period from December 18 to March 20. THEREFORE, the City of Aspen hereby certifies that the fourteen day owners' use restriction stated in Section 35 of the Condominium Declaration for The Aspen is no longer required as a condition to approval for the condominium ization of a lodge in the City of Aspen and The Aspen is released from such restriction. The Application concerns The Aspen condominium project, consisting of 38 condominium units, of lodge room character, without kitchens, which are used for overnight lodging by the general public on a short term basis for a fee. The Application requests release by the City of Aspen of the obsolete owners' occupancy restrictions contained in Section 35 of the Condominium Declaration for The Aspen recorded in the Pitkin County records on January 9, 1984, at Book 458, Page 829, Reception No. 256314, which limit owners' use of their units to not more than 14 days during the seasonal period of December 18 through March 20. The provisions of Section 35 of the Declaration provide that in the event the City of Aspen amends or repeals those portions of its Municipal Code such that the restrictions contained in said section are no longer required as a condition to approval for the condominium- ization of a lodge, then the restrictions contained in said section shall be deemed to lapse and the Board of Directors of the Association shall be authorized to obtain from the City of Aspen and Jessica Garrow May 1, 2015 Page -2- record a certificate which reflects that the property is released from such restrictions. A full copy of the Declaration is submitted herewith for your easy reference. It is the Association's understanding that upon release of the owners' occupancy restrictions contained in the Declaration, the current maximum occupancy periods stated in Section 26.104.100 of the City of Aspen Land Use Code will apply, specifically occupancy periods by any one person or entity with an ownership interest in a unit which shall not exceed thirty consecutive days or exceed a total of ninety days within any calendar year, regardless of the form of ownership. It's our further understanding that multiple owners of a single unit will be considered one person for purposes of the restrictions. In other words, each of multiple owners of a unit will not be entitled to separately take advantage of the 30 day and 90 day periods with regard to their particular unit. In addition to the completed Land Use Application, submitted herewith are the signed Agreement to Pay Application Fees, an Attorney's Certification listing names of all owners of units at the property and demonstrating the Association's authority to submit the Application, Homeowner Association Compliance Policy, and an 8 Y? by 11 " vicinity map locating the property within the City of Aspen. A proposed Certificate of City of Aspen, Colorado, Concerning Amendment to City Imposed Personal Use Restrictions Applicable to Units in the Aspen Condominium Project for execution by the City and recording in the Pitkin County records upon approval of the Application is also enclosed. This proposed Certificate serves as a written description of the proposed amendment. Upon your confirmation that the application package appears complete and acceptable for review, the Association will promptly tender the $1,300 deposit required for review of the application. M C.) > v, A car 0 r__1 Land Use Review Fee Policy The City of Aspen has established a review fee policy for the processing of land use applications. A flat fee or deposit is collected for land use applications based on the type of application submitted. A flat fee is collected by Community Development for applications which normally take a minimal and predictable amount of staff time to process. Review fees for other City departments reviewing the application (referral departments) will also be collected when necessary. Flat fees are cumulative — meaning an application with multiple flat fees must pay the sum of those flat fees. Flat fees are not refundable. A review fee deposit is collected by Community Development when more extensive staff review is required. Actual staff time spent will be charged against the deposit. Various City staff may also charge their time spent on the case in addition to the case planner. Deposit amounts may be reduced if, in the opinion of the Community Development Director, the project is expected to take significantly less time to process than the deposit indicates. A determination on the deposit amount shall be made during the pre -application conference by the case planner. Hourly billing shall still apply. All applications must include an Agreement to Pay Application Fees. One payment including the deposit for Planning and referral agency fees must be submitted with each land use application, made payable to the City of Aspen. Applications will not be accepted for processing without the required application fee. The Community Development Department shall keep an accurate record of the actual time required for the processing of a land use application requiring a deposit. The City can provide a summary report of fees due at the applicant's request. The applicant will be billed for the additional costs incurred by the City when the processing of an application by the Community Development Department takes more time or expense than is covered by the deposit. Any direct costs attributable to a project review shall be billed to the applicant with no additional administrative charge. In the event the processing of an application takes less time than provided for by the deposit, the department shall refund the unused portion of the deposited fee to the applicant. Fees shall be due regardless of whether an applicant receives approval. Unless otherwise combined by the Director for simplicity of billing, all applications for conceptual, final, and recordation of approval documents shall be handled as individual cases for the purposes of billing. Upon conceptual approval all billing shall be reconciled and all past due invoices shall be paid prior to the Director accepting an application for final review. Final review shall require a new deposit at the rate in effect at the time of final application submission. Upon final approval all billing shall again be reconciled prior to the Director accepting an application for review of technical documents for recordation. The Community Development Director may cease processing of a land use application for which an unpaid invoice is 30 or more days past due. Unpaid invoices of 90 or more days past due may be assessed a late fee of 1.75% per month. An unpaid invoice of 120 days or more may be subject to additional actions as may be assigned by the Municipal Court Judge. All payment information is public domain. All invoices shall be paid prior to issuance of a Development Order or recordation of development agreements and plats. The City will not accept a building permit for a property until all invoices are paid in full. For permits already accepted, an unpaid invoice of 90 or more days may result in cessation of building permit processing or issuance of a stop work order until full payment is made. The property owner of record is the party responsible for payment of all costs associated with a land use application for the property. Any secondary agreement between a property owner and an applicant representing the owner (e.g. a contract purchaser) regarding payment of fees is solely between those private parties. Publication - Publication of notice in a paper of general circulation in the City of Aspen is to be done at least fifteen (15) days prior to the hearing.
