Chrisloper Vasquez, of Amerigas ppx, o",ner, has requested an Exemption by the Community
Development Director of the Growth Management Quota System (GMQS) provisions pursuant to
Section 26.102.040 of the Land Use Code. The action that triggers the GMQS provisions is a
request to use a small portion of the parking lot at City Market for a 12' by 2' structure which
stores propane tanks. The facility is llsedfor customers to exchange used propane tanks for new
ones, and is essentially a self-serve operation.
The request qualifies for this exemption by determination that the following conditions exist.
1. The expansion is not greater than p".'O hundred fifty (250) square feet of net Ie asableareain
SIze.
2. The expansion will generate a minimal number of additional employees. Based upon Staffs
calculation, there is no employment impact of the propane tank facility_
3. The expansion will generate the demand for aminimal number of parking spaces associated
with the use of the property. Staff calculates the demand for parking 10 be immeasurable.
Typically, a customer does uot park just for the propane tank facilities, but shops at the
grocery store as well.
4. The structure is in keepingYvith other outside vending activities at City Mark et.
5. Overall, there will be minimal, if any, additional demands upon the provision of public
fucilitiesand services due to the expansion.
A referral to the Housiug Office was made regarding this issue, and they informed staff that no
employee mitigation is required (see attached memo). .
The Community Development Director may approve an exemption to the GMQS provisious. For
the above noted reasons and findings, I recommend lhat you approve of an e xemptionforthisnel
leasable area expansion contingent the applicant's acceptance, below:

I have reviewed the operation of the propane tank refill at City market. Although the
facility does no create any net feasible areathat would ordinarily be subject t ogrO\vth
mitigation, 1 have been asked to examine the potential employment impact.
The facility is essentially self-help, with full propane tanks located ina locked cage
adjacent to the building on the outside. There is no additional or new roof space.
Customers are asked to leave their empty tank at the cage, enter the store, pay fora refill
and get the customer service representative to unlock the cage. There is no one whose
sole duty is to see W or maintain the tanks.
TIlls appears to have either no employn1ent impact, or an impact that is immeasurably
smalL It is very important to note how this facility differs from additions to commercial
operations that have an impact. This facility does not provide a space for an employee to
provide a service.
In my opinion, there is no employment impact of the propane tank facility at City Market.

Hailey, requesting thai the propane display be removed by March 12, 1999. Our
understanding of the pennissible areas outside this store for display area are the same
as yours, and we agree that this is not one of them. We have instructed the vendor
who owns and who installed the propane display to move it.

space, an exemption from the GMQS = be granted by lhe Community Development

employee generation and parking demands.
I have enclosed a copy of our definition of "net leaseable commercial space" alon gwith
an application packet for a GMQS staff leve~ exemption. Attachment 5 of.tli.e packet
outlines the standards applicable to receive the exemption. Please complete the packet
andteturnto our office with a deposit mthe amount of$460.00 (payable to the
Aspew'Pitkin Community Development Deparnnent) by no later than :'vlarch.15, 1999.
We will allow the propane display to remain in irs current location \vhile our departme ilt
is reviev,ing your appiicatioil. However, if your GMQS exemption request is denied by
our Department the' propane display-stand will have to be removed within forty eight (48)
hours of notice of that determination.

1. Attendpre-application conference. During this one-on-one meeting, staffwill determine
till: review process which applies to your development proposal and will identify the materials

2. Submit DevelopmentApplication. Based on your pre-application meeting, you should
respond to the application package and submit the requested number of copies of the complete
application and the appropriate processing fee to the Community Development Department.
3. Determination of Completeness. Within five working days oithe date of your
submission, staffwill review the application, and will notify you in writing whetherPw application
is complete Ol'ifadditional materials are required. Please be aware that the purpose of the
completeness review is to determine whether or not theinformmion you rul\'e submitted is adequate

The placement ofLPO cabinets shall conform to the following criteria:
A. The location from each cabinet containing LPG containers shall be kept, al minimum,
5 feet from any access/egress routes.
B. Combustible materials shall be kept, at minimum, 10 feet from LPG containers.
Incompatible materials shall be kept, at minimum, 20 feet from LPG containers,
andIorseparated by a wall, partition, or approved storage cabinet. In order to
maintain the appropriate distance. LPG cabinets shall be marked by II yellow border
indicatingalOfootperimeter.
c. Cabinetsshallbecovered,andlorp1acedinacoolarelltoefuninatethepossibilityof
expose to excessive temperatures, and securely locked to prevent physical damage or
tampering
D. Vehicles will not be permitted within 10 fuel ofLPO cabinets, with the exception of
vehicles belonging to AmeriGas PPX or one of its representatives, or in the event of
an emergency, (i.e., Police or loca1 fire department).
II. Containel\\lllDd Damaged Container Policy
A. All LPG containers shall be stored upright in II lockable, ventilated cabinet to preverrt
damage and/or theft. Containers shall be protected by collars or screw-on-type caps,
and outlet valves shall be closed and plugged when not in use.
B. Employees of this facility sha11 not exchange any LPG containers that may be
damaged, leaking, corroded or pose a potential threat to customer and employee
safety, inacoordance with the procedures established by 92 NFPA 58, 91 UFC: 2, 13,
80 and 82, the Local Emergency Planing Committee's, and the State Emergency
Response Commission. Customers wishing to return or exchange damage or leaking
containers. will be referred to AmeriGas PPXs' main plant, where the containers will
be removed from service, and repaired or disposed ofin an approved lllWlller.

IV. Signs,PlacanlsandDocumentation
A. Approved NFPA 58 hazard identification signs, and procedural and wlU'Ding signs,
shall be properly posted on or around all LPG cabinets. Signage shall provide for the
following:
1. Nosmokiogwithin25feet.
2. Exchange procedures, company name and telephone number.
3. NFPA 704 Hazard Identification sign.
4. Instructions for containers to be left outside.
5. Fire department permit to be posted in a conspicuous p1ace.
B. Hazardous Chemical Inventory reporting forms, Material Safety Data Sheets, written
cylinder exchange procedures and all supporting documentation are to be kept with
tbisfacilitiesSARA Title III information, located in the main oflices. and are to be
retainedthereatalltimes.

V. Employee Training and Certification
A. Manager and Superv1sor training will be the responsibility of AmeriGas PPX and
shall follow the training procedures supplied by AmeriGas PPX. Facility managers
will have final responsibility for employee training at the facility level. All employees
responsible for the operation of the LPG cabinets shall be trained in proper handling
and operating procedures. Properly trained personnel shall be available, at all times,
to assist in the LPG exchange procedure. (Refer to the Training Procedures-

A. A written inspection checklist will be used to monitor and ascertain the safety and
reliabi!ity of all cylinders to be exchanged, Checklists will be used to detenninethe
following:
1. Jdentification of protective collars.
2. Manual shutoff valves dosed and secure.
3. Safety valves in good operating condition. 01alves:freefrombends,defunnation
or thread damage.)
4. P.O.L. plug installed in outlet.
5. DOT label and cy!inderwarning label firmly affixed,
6. Cylinders free from fire damage, corrosion, leaks, bulges, gouges, punctures, rust
or that pose a potential threat to customer and employee safety.

VII. HandlingProcedures
A. Only certified employees will have access to LPG containers for the purposes of
exchanging or inspecting containers. At no time will customers be a1lowed to bring

B. All employees shall follow the detailed procedural guide provided by AmcriGas
PPX. (Refer to the Training Procedures - Training video tape, supplied by
AmeriGas PPX.)
VOl. Emergency Response Procedures
The fullowing procedures have been developed fur responding to a Liquefied Petroleum
Gas (LPG) release. Any release involving the LPG cabinets shall be considered a release

A. Responsibilitie!l of the facility Emergency Response Coordinator in the Event of
a Release of Hazardous Materinls
1. ThecoTlt~m;n~tedarea will be secured by cordoning off the area with tape, cones
or other devises to effectively prevent any unauthorized access.
2. Evacuation of the innnediate area, if appropriate, will fullow evacuation
procedures detailed below.
3. Notification of the Emergency Response Authority will be immedia1e, by dialing
911. The Emergency Response Authority will work with the fucility Emergency
Response Coordinator (ERe) and assist in the notification of the proper
agencies, Le., the Jm,al Police Dept., the Colorado Department of Health and
Environment, the National Response Center, the EPA, etc., as necessary,
4. The ERCwill identifytbe source, quantity, time and duration of the re1ease, and
the cause oithe emergency. This should include, but.m not limited to, materials
that have become waste as a result of the release (i.e., material released due to
ruptured tanks, etc.). 'The ERe will detennine the medium, media or nature of
the environment into which the re1ease occurred,as well as the potential e:Erects
and necessary safety precautions; including any personal protective equipment
which may be needed.
5. 1be ERe will assess the extent of any injuries and potential hazards to human
health or the environment. The assessment must include direct and indirect
effectsfrol11firesandexploskllls.
6. A responsible person will be assigned to meet the Emergency Response
Authorities at the facility's main entrance and lead the team to the e111ef!lency
site.
B. Potential Evacuation
Initiation of the evacuation procedure is the responsibility of the facility Emergency
Response Coordinator (ERC). 1be ERC fur this facility will be the senior supet'Visor
on duty.
Evacuationroutes are posted throughout the facility and all employees have reviewed,
and are familiar with the procedure. In addition periodic testing of the alann system
will be conducted to fumi1iarize employees with the alarm sound and evacuation
procedures.

Under certain emergency conditioIlS; it may become necessary to evacuate specific
areas, and possibly the entire facility. Emergencies that may be anticipated are:
. Fire - Of sufficient magnitude that employee safety is endangered.
. LPG Release _ Hazardous, flammable gases contaminating the ambient air so that
employee safuty in endangered.
. WeatherandNaturalDisasters-Situationswherethereisapotentialdangerto
employee safety, i.e., earthquakes, floods, tornadoes, etc.
If the potential exists for an evacuation, due to a fire,LPG re1ease or natural disaster,
the ERe will proceed as follows:
1. A determination will be made based on all available information, as well as
discussions with the Emergency Response Authorities, whether a facility or area
evacuation is warnmted. O.e., the emergency could cause an innnanent threat to
human health or the environment due to ",fuds, or other circumstances which are
moving the release off-site.)
2. If it is determined that an evacuation is warranted, the a1ann system or other
internal notification device will be activated to initiate the evacuation and the
following procedures will be observed:
a. All non-essential personnel will be relocated in order to provide protection.
In the event ofa fire, explosion or release, in excess of the Reportable
Quantities (RQ), the entire fucility or a major portion of the facility will
evacuated,
b. Eva<:uatkm of personnel will be accomp1ished by either one-on-one
communication,PAoralarmsystemnotificmion.
c. The ERe will ensure the area is clear of all non-essential personnel and will
assume site security. Employees and customers who may be affected due to
exposure from hazatdous substances will be relocated to a safe distance from
the release, or any potential releases which may occur.
d. Evacuation of the building will follow the posted evacuation routes. Care
will betaken to ensure that all elderlyand/or handk:apped employees and
customers are escorted safely from the building.

Propaneinitsnaturalstateisodorless:therefore,adistinctiveodorantwitha foul smell i, added to
