General — (1) These comments are based on the fact that we believe that the submitted site plan is
accurate, that it shows all site features, and that it is feasible. The wording must be carried forward
exactly as written unless prior consent is received from the Engineering Department. This is to halt
complaints related to approvals tied to "issuance of building permit." (2) If there are any
encroachments into the public right-of-way, the encroachment must either be removed or be subject
to current encroachment license requirements.
1. The plat contents are complete with the exception of needing the zone district stated in the notes.

Condominium, located on Snowbunny Lane, in the Wes ow Subdivision.

Per the Condominium Use Agreement (recorded Febr::ary 15, 1990) and approvals
from the Pitkin County Building Department, the osmer of Unit 1, Leeper/
Spalding Condominium constructed a detached garage, with the consent of the
owner of Unit 2. The enclosed map is a re -drawing of the Condominium Map
showing the addition and location, of this garage.
The owners of both Units 1 and 2 of the Leeper/Spalding Condcminiu^> now
desire to have the redrawn Condominium Map recorded and thus are submitting
it to your departments for review, approval and sign off.
I appreciate your attention to this matter, as the o:.-ner of Unit 1, Leeper/
Spalding is selling her `::nit. One of the requirements for the sale is a
properly recorded amended plat.

This Condominium Use Agreement made thisi" day of
i°•'ca�9, by and between Michael L. Spalding and Anna E. Spalding
(hereinafter collectively "Spalding") and James F. Dykes and Joan
P. Dykes (hereinafter collectively "Dykes").
1. RECITALS•
1. Dykes own Unit 7#1, Condominiums and
Spaldings own condominium unit #2, Leeper/Spalding condominiums,
according to the condominium plat thereof, recorded February 28,
1986, in Plat Book 18 at page 81, and as defined and described in
the Condominium Declaration for the Leeper/Spalding condominiums,
recorded November 5, 1986, in Book 522 at page 115, of the
Records of the Pitkin County Clerk and Recorder.
2. Subsequent to the purchase of Unit #1, Dykes con-
structed a garage, which is located in the northwest corner of
the condominium property.
3. The parties desire to set forth their understanding
that the garage constructed by Dykes be deemed appurtenant to and
for the exclusive use of the owner of condominium unit #1.
NOW, THEREFORE, The parties agree as follows:
1. The parties acknowledge, understand and agree that the
garage structure located in the northwest corner of the con-
dominium property, which structure was constructed and paid for
solely by Dykes with the consent of the Spaldings, shall be a
limited common element appurtenant to unit #1 and for the ex-
clusive use of the owner or owners, from time to time, of unit #1
Leeper/Spalding Condominiums according to the Condominium Plat
thereof recorded February 28, 190-6, Plat Book 18 at,_- page 31. f::c
condominium plat shall be deemed to be amended accordingly.
Further, the construction of the garage shall be without prejud-
ice to owner of unit #1 to claim all space currently designated
on the plat as and attributable to unit #1, as habitable living
area (i.e. F.A.R.-floor area ratio).
2. This agreement shall be deemed to run with the land,
shall be a burden upon and a benefit to the parties and their
heirs, personal representatives, successors and assigns and any
persons acquiring or owning an interest in the condominium
property.

3. This Agreement may be recorded in the Records of the
Pitkin County Clerk and Recorder.
