Julie Ann Woods, Community Development Directol,><"r-\j Chris Bendon, Senior Planner ~ Truscott SubdivisionIPUD Amendment 2nd Reading of Ordinance No. 42, Series of 2001 FROM: RE: DATE: November 12,2001 SUMMARY: The Subdivision and PUD approvals for the Truscott Affordable Housing and Aspen Golf and Tennis Club project created four parcels (see attached map). Subsequently, the Housing Authority discovered that the project financier would require a legal interest in adequate parking, This created an issue with the "off-site" parking located in the large parking lot for use by the Truscott residents. The recorded SubdivisionIPUD Plat depicted five parcels, the fifth being the parking lot designated for the affordable housing, The recorded plat does not coincide with the Subdivision Ordinance. Because the fifth lot is necessary to the developer and the plat already depicts this lot, staff suggested an amendment to the subdivision ordinance to rectifY the inconsistency. The Subdivision amendment may be approved by City Council and does not require a new subdivision application. No additional development rights are created or conveyed by this action and no substantive changes to the project are being proposed. This action will clarifY the current discrepancy between the Ordinance and the plat. Clarifying language is also included in the proposed Ordinance describing lot 5 as parking (not for a building). Again, no substantive changes are being proposed, only a change in the paperwork associated with the project. Staff recommends approval of Ordinance No. 42, Series of 2001. LOCATION: Aspen Municipal Golf Course, State Highway 82, 1 1"'\. r"\ PREVIOUS ACTION: The City Council approved the Aspen Golf and Tennis Club/Truscott Affordable Housing Subdivision and PUD pursuant to Ordinance 34, Series of2000, The project is currently under construction. First reading of this Ordinance was conducted on October 9,2001. REVIEW PROCEDURE: Subdivision Amendment. The City Council shall approve a Subdivision amendment, provided that the amendment is consistent with the approved plat. Insubstantial PUD Amendment. The Community Development Director shall approve, approve with conditions, or deny a PUD amendment consistent with the project's original approval and which does not require granting a variation from the project's uses or dimensional requirements. (The PUD Amendment has been procedurally combined with the Subdivision Amendment.) RECOMMENDATION: Staff recommends City Council approve Ordinance No. 42, Series of2001. RECOMMENDED MOTION: "1 move to adopt Ordinance No. 42, Series of2001." The focus of this justification is in regard to Tax Credits and Tax Exempt Bond Financing for the Housing portion of the Truscott project. CHFA (Colorado Housing Finance Authority) and the "Syndicator" will require that the project has what they deem to, be "adequate" available parking for the residents. In order to satisfy these requirements we will need to provide documentation that the parking exists and is available to the residents of Phase 2. The "existence" of this parking is most easily accomplished by creating an individual legal parcel encompassing the parking lot. The "availability" to the residents of Phase 2 will be accomplished by providing either a use agreement and/or an easement giving Phase 2 the right, at least on paper, to utilize the required number parking spaces in the parking lot (the new Lot No.5) If you require additional information and/or clarification please feel free to contact me. r"'1 ~ ,,~~v TO: MEMORANDUM .. ,~/ Julie Ann Woods, Community Development Director ./ v James Lindt, Acting Zoning Officer :::L I FROM: RE: Truscott Subdivision Error DATE: July 18, 2001 SUMMARY: During the Plat recordation process for the Truscott Affordable Housing Project, an additional lot was added to the subdivision plat that was not approved by City Council. Therefore, the condition in the approving ordinance that calls for the Subdivision data to be supplied to the GIS Department prior to building permit issuance will not be met prior to issuance of building permits for all of the lots except for Lot 5. Building Permits will be issued for the other lots under the condition that the subdivision error will be corrected within 180 days and that the correct subdivision data will be supplied to the GIS Department upon correction of the error. We hope this could be done as a consent item on a Council Agenda. As you all know, the financing for this project is anything but simple and this issue is the result of the complexity of the financing. Ordinance 34-2000, dated August 14, 2000, approved the Final PUD for the entire Truscott Project which in Section 2 identified Lots 1,2,3 and 4. At that time Lot 3 included the parking area for Phase 2. In the process of working out the financing details, it was determined that the parking area had to be a separate lot, therefore, the designation of LOT 5. I hope that you can make your recommendation to the City Council in those simple terms because it is that simple. Please call me to assist you with any required paperwork or further explanations.
