The lots subject to the proposed lot line adjustment are Lots 43, and 44, West Aspen Subdivision. The request is to swap three hundred eighty nine (389) square feet of lot area located on the southwest portion of Lot 44 for three hundred eighty nine (389) square feet of lot area located on the northeast portion of Lot 43. Community Development staff recommends approval of the requested Lot Line Adjustment to the West Aspen Subdivision. OWNER: Robert and Khara Horning APPLICANT: Robert and Khara Horning, represented by Curtis Sanders LOCATION: 1005 Cemetery Lane and 1430 Silverking Drive ZONING: R-15 BACKGROUND: This proposed application would allow the Hornings to landscape they way wish on Lot 44 by swapping a steep portion of land to Lot 43. The portion of land that is proposed to be given to Lot 43 is very steep, whereas the portion of land proposed to be given Lot 44 has a lesser slope and is more conducive to landscaping. The Hornings have received written consent from the owners of Lot 43 to apply for the Lot Line Adjustment. REVIEW CRITERIA & STAFF FINDINGS 1. Section 26.480.030 (A) Subdivision Exemptions In order for this proposal to qualify as a Subdivision Exemption, the request must comply with the review criteria in Section 26.480.030 (A), General Exemptions, which reads as follows: . A. General Exemptions 1. Lot Line Adjustment. An adjustment of a lot line between contiguous lots if all the following conditions are met: a. It is demonstrated that the request is to correct an engineering or surveying error in a recorded plat or is to permit an insubstantial boundary change between adjacent parcels; and Staff Finding Community Development Staff finds the proposal meets this review standard in that the proposed lot line adjustment permits an insubstantial boundary change. The proposed insubstantial boundary change will not affect the development rights on either of the subject parcels because they are trading an equal amount of lot area. b. All landowners whose lot lines are being adjusted shall provide written consent to the application; and Staff Finding Community Development Staff finds that the proposal meets this review standard in that written consent was provided by Robert and Khara Horning, the owners of Lot 44. Written consent was also given by Sky Island Enterprises LLC., the owner of Lot 43. These are the only effected property owners by this Lot Line Adjustment. c. The corrected plat will meet the standards of this Chapter, and conform to the requirements of this Title, including the dimensional requirements of the zone district in which the lots are located, except in cases of an existing nonconforming lot, in which the adjustment shall not increase the nonconformity of the lot. The plat shall be submitted and recorded in the office of the Pitkin County Clerk and Recorder. Failure to record the plat within a period of one hundred eighty (180) days following approval shall render the plat invalid and reconsideration of the plat by the Community Development Director will be required before its acceptance and recording; and Staff Finding The Community Development Staff finds that the proposal meets this review standard in that the proposed lot line adjustment will not increase a nonconformity on the effected parcels. d. It is demonstrated that the lot line adjustment will not affect the development rights, including any increase in FAR, or permitted density of the affected lots by providing the opportunity to create a new lot for resale or development. A plat note will be added to the corrected plat indicating the purpose of the lot line adjustment and the recognition that no additional FAR will be allowed with the adjustment. Staff Finding Community Development Staff finds that the proposal meets this review standard in that the proposed lot line adjustment will not increase the development rights on any of the effected properties because the applicants are proposing to trade three hundred eighty nine (389) square feet each. The lot line adjustment plat shall include a plat note that acknowledges that no additional FAR results from the insubstantial boundary change. The utility easement that currently borders each of the parcels will not be effected and will not effect the development rights on either parcel by the proposed lot line adjustment because they are not excluded from lot area for purposes of calculating allowable FAR. RECOMMENDATION: Staff recommends approval of the Lot Line Adjustment at 1005 Cemetery Lane with the following conditions: 1. The applicant shall submit and record a Subdivision Exemption Plat indicating the lot line adjustment within 180 days after the date of this approval. 2. Any landscaping or development completed within the five (5) foot utility easement that currently boarders both parcels is developed at the owner's risk. Utility Company Personnel shall not be liable for the cost of repair or replacement of landscaping or development within the aforementioned easement.
