AN ORDINANCE OF THE ASPEN CITY COUNCIL AMENDING SECTION 24-3.2 OF
THE NUNTCTPAL CODE, PERMITTED AND CONDITIONAL USES, TO ALLCYd AS
CONDITIONAL USES MAINTENANCE SHOPS AND EMPLOYEE HOUSING FOR THE
ENPLOYHES OF THE PUBLIC USE IN THE PUBLIC ZONE DISTRICT
WHEREAS, The Planning Office has requested that either the
Planning and Zoning Commission or City Council initiate an
amendment to Section 24-3.2 of the Municipal Code in conjunction
with an application from the Aspen Consolidated Sanitation
District for permission to build a maintenance shop, office
space, and employee housing at 565 N. Mill Street, as provided by
Section 24-12.3; and
WHEREAS, the Planning and Zoning Commission reviewed the
proposed code amendment for maintenance shops and employee
housing as a conditional use within the public zone district at a
public hearing held during their regularly scheduled April 8,
1986 meeting; and
WHEREAS, the Commission determined that maintenance shops
and employee housing may be inappropriate in the public zone
district and voted 5 opposed and 1 in favor to recommend to
Council denial of the proposed code amendment; and
~HIEREAS, the Aspen City Council finds that the uses identi-
fied herein meet the intention of the public zone district and
should be allowed as conditional uses, thereby giving the Aspen

Planning and Zoning Commission authority to review such uses on a
case-by-case basis; and
WHEREAS, the Aspen City Council determined that it wished to
adopt this amendment to Section 24-3.2.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
That Section 24-3.2 of the Municipal Code be and hereby is
amended to remove the language "(except maintenance shops)" in
the table of permitted uses and add "maintenance shops and
accessory employee housing for employees of the public use of the
site" as conditional uses in the public zone district.
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
A public hearing on the ordinance shall be held on the =~

Aspen City Hall, Aspen, Colorado, 15 days prior to which hearing
notice of the same shall be published once in a newspaper
ofgeneral circulation within the City of Aspen.
