AN ORDINANCE APPROVING AN AMENDED INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF ASPEN, COLORADO, AND PITKIN COUNTY, COLORADO,
PROVIDING FOR THE CREATION, OPERATION AND MAINTENANCE OF A PUBLIC
TRANSPORTATION SYSTEM BY A JOINT TRANSIT AGENCY WHICH AGREEMENT
REVISES AND SUPERCEDES THAT INTERGOVERNMENTAL AGREEMENT DATED
NOVEMBER 21, 1983, TO INCLUDE ALL AMENDMENTS, SUPPLEMENTS AND
ADDITIONAL PROVISIONS TO SAID AGREEMENT, AND AUTHORIZING AND
DIRECTING THE MAYOR TO EXECUTE SAID AGREEMENT
WHEREAS, City and County established the Roaring Fork Transit
Agency by Intergovernmental Agreement dated November 21, 1983,
which agreement was amended and supplemented as follows:
- Supplemental Agreement dated November 21, 1983;
- Amendment to Intergovernmental Agreement dated January 23,
1984;
WHEREAS, City and County desire to enter into the Amended
Intergovernmental Agreement, attached hereto and incorporated
herein, to comprehensively reflect and incorporate into one docu-
ment all pertinent amendments and supplements, as well as addi-
tional provisions requested by the Urban Mass Transit Authority
and that Intergovernmental Agreement to implement the Transit
Sales Tax, dated May 13, 1985.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does hereby
approve the Amended Intergovernmental Agreement between the City
of Aspen and Pitkin County, attached hereto and incorporated by
this reference; and does further authorize the Mayor, on the
effective date of this ordinance, to execute said agreement on
behalf of the City of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
Section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be con-
tinued and concluded under such prior ordinance.
Section 4
A public hearing on the ordinance shall be held on the ~
day of _~ , 1986, at 0100 Lone Pine Road,
