HomeMy WebLinkAboutordinance.council.049-02 ORDINANCE NO. 4q (Series of 2002) AN ORDINANCE AMENDING CERTAIN SECTIONS ON AN ANNUAL BASIS FOR THE ASPEN/PITKIN COUNTY AFFORDABLE HOUSING AND OTHER AMENDED CHANGES AS STATED IN THE GUIDELINES AS RECOMMENDED BY THE ASPEN/PITKIN COUNTY HOUSING AUTHORITY WHEREAS, pursuant to the Municipal Code of the City of Aspen, as amended, the Housing fucome, Eligibility Guidelines and Housing Price Guidelines are to be established by the City Council; and WHEREAS, pursuant to prior resolutions and ordinances of the City, the City Council established Employee Housing fucome-Eligibility Guidelines and Housing Price Guidelines for prior years; and WHEREAS, the Affordable Housing Guidelines ("Guidelines") were approved by City Council on October 26, 200 I and at such time, the City Council approved the process ofreviewing the Guidelines as a whole every three to five years; WHEREAS, the Housing Board approved Resolution No. 2002-03, A Resolution of the AspenlPitkin County Housing Authority Board Approving Amending Certain Pages of the AspenlPitkin County Affordable Housing Guidelines in January of Each Year, on July 31. 2002, allowing the AspenIPitkin County Housing Authority (APCHA) staff to do automatic updates of certain sections, as specified below, of the Guidelines in January of every year; WHEREAS, an automatic update of specific sections of the Guidelines, as stated below, every January would better serve the community by providing accurate and up-ta-date income requirements, rental rates and increases, and sales rates and increases; and WHEREAS, the information to amend the specific sections is obtained by using the Consumer Price fudex from November to November and is obtained by the Housing Offic:e by the end of December of each year; and WHEREAS, that it does hereby approve an annual update of the Guidelines of certain sections attached hereto and made a part hereof, with review of the Guidelines every other year by the elected officials and as stated in the Third Amended and Restated Intergovernmental Agreement; and WHEREAS, the Board approves all of the additional changes in the Guidelines and delineated in RED; NOW, THEREFORE, BE IT ORDAINED BY THE CITY C01JNCIL OF THE CITY OF ASPEN, COLORADO, that the following sections of the Guidelines shall be approved every January automatically, without the need of further review and approval by the APCHA Board, the Board of County Commissioners and City Council: Section I That the City Council of the City of Aspen hereby approves the APCHA staffto amend the sections stated below on an annual basis, by using the consumer price index, as recommended by the Board of Directors of the APCHA, a copy of which is annexed hereto and incorporated herein, and specifically stated below: Part No. Section No. Paragraph No. Page No.. Section 2 Maximum mcomes for Rental & Sales/Ownership Units Maximum mcomes for Rental Units Only Maximum mcomes for Sales/Ownership Units Only 3.a., RO mcoine and Asset Limitation I, Maximum Sales Price ofRO Units Gross mcome for RO-5 Units at Williams Ranch mcome and Sales Price Maximums for RO Units Maximum Sales Unit Prices for Aspen and Pitkin County Maximum Monthly Rental Rali:s Payment-in-Lieu Fee Rental mcrease for Existing AH Units Maximum mcomes by Category 4 5 II 14 22 31 32 34 35 38 42 49 That any specific areas of the Guidelines shall be reviewed when din:cted by the Housing Board, the BOCC and/or City Council and as specified in a work plan approved on an annual basis by said parties. 2 Section 3 That the specific sections of the Guidelines set forth and adopted herein shall supersede to the extent incons.istent with the provisions of this Ordinance, all prior resolutions and ordinances of the City of Aspen; provided further that the provisions of resolutions and ordinances pertaining to employee housing guidelines shall remain in full force and effect to the extent not inconsistent with the regulations and guidelines adopted herein. Section 4 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. Section 5 Nothing in this Ordinance shall be construed. to affect any right, duty or liability under any ordinance in effect prior to the effective date of this Ordinance, and the same shall be continued and concluded under such prior ordinances. Section 6 A public hearing on the Ordinance shall be held on the 13th day of January, 2003, in the City Council Chambers, City Hall, Aspen, Colorado.
