AN ORDINANCE OF THE CITY COUNCIL OF ASPEN, COLORADO,
IMPOSING A SIX (6) NONTH TEMPORARY MORATORIUM
ON THE ACCPE~NCE AND/OR PROCESSING OF ANY APPLI(~TION
FOR A BUILDING PER~IT FOR THE DF~OL IT ION OR REMOVAL OF
ANY STRUCTURE SURVEYED IN THE 1980 ASPEN INVENTORY OF
HISTORIC SITES AND STRUCTURES AS AMENDED
WHEREAS, the City of Aspen is in the process of a~opting the
Aspen Area Comprehensive Plan.- Historic Preservation Element
(hereinafter "Element"); and
WHEREAS, on August 25, 1986, the City Council adopted
Resolution No. 25, Series of 1986 endorsing the Element and
identifying as its highest priority implementation action a Code
amendment to provide for a public review procedure prior to
issuance of a demolition permlt for any historic structure; and
WHERE~S, in an effort to be fair and comprehensive, measures
to protect significant historic structures must be carefully
considered; and
WHEREAS, the establishment of a moratorium on the demolition
or removal of any structure surveyed in the 1980 Aspen Inventory
of Historic Sites and Structures as amended will enable the Aspen
Planning and Zoning Commission and the City Council of Aspen,
Colorado, to study and, if necessary, consider changes to the
Zoning Code of the City of Aspen, Colorado, as they pertain to a
demolition and removal review procedure, including deciding
whether to employe a townsite historic district, mandatory City

designation procedure or similar approach to protect the historic
character of Aspen.
NOW, THEREFORE, BE IT ORE~INED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
That for a period of six (6) months from the effective date
hereof, a moratorium is hereby imposed on the acceptance and/or
processing of any application for a building permit for the
demolition or removal of any structure surveyed in the 1980 Aspen
Inventory of Historic Sites and Structures as amended.
That pursuant to aforesaid moratorium and during a period of
six (6) months from the effective date hereof, the Building
Inspector is hereby directed not to issue any permits for the
demolition or removal of structures surveyed in the 1980 Aspen
Inventory of Historic Sites and Structures as amended.
Council may by Resolution exempt a pending application from
the restriction of this moratorium, if, upon special review after
considering the recommendation of the Historic Preservation
Committee, the City Council finds that the structure proposed to
be removed or demolished is not, in fact, historically or archi-
tecturally significant.

If any section, subsection, sentence, clause, phrase, or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competnent jurisdiction, such
portion shall be deemed a separate, distinct, and independent
provision, and such holding shall not affect the validity of the
remaining portions thereof.
A public hearing on the ordinance shall be held on the ~
day of ~, 1986, at 5:00 P.M. in the City Council
