Gentlemen,
Please find the Mylar's for the Block E snbdivision map at Aspen Highlands Village requiring your
signatures enclosed. Please note that all of your redline comments have been incorporated into the final
submission.
Additionally:
. Please note the letter enclosed from our attorney, Greg Perkins, to our civil engineer, Steve Ehlers,
requesting the inclusion of additional language. Plat Note 4 specifically, iis required based on
direction provided by John Worchester, City of Aspen Attorney, based on concerns voiced by the
building inspector, Tom Parry. Everything should be in order though you may want to touch base
with Mr. Worchester.
. New language was added to Plat Notes 5 and Easement Note 2 based on internal Hines review. We
hope this language is acceptable.

SUBJECT: Aspen Highlands Community Housing Condominium Map
Per our telephone conversation today, attached is acopy of the Map, marked with my
comments. In addition to those changes, please do the following:
ADD NEW NOTE 4 TO EASEMENT SECTION, AS FOLLOWS:

4, Junction Box Easement. A non-exclusive easement ("Junction Box Easement") to the
successor owners of the benefited Units described in this Note 4 on, over, under, above and
through those portions of the burdened Units described in this Plat Note as are necessary for
access to and use electrical feeders, conduits, junction boxes and associated equipment located
within the burdened Unit but which provide utility service to the benefited Unit. Such access
and use shall be permitted only after three (3) days prior written notice to the Owner of the
benefited Unit in the manner provided in the Declaration, except that immediate access shall be
granted in the event of an emergency, The Junction Box Easement shall benefit and burden
certain Units, as follows:
a, The Junction Box Easement shall burden Unit 2 for the benefit of Unit 1.
b, The Junction Box Easement shall burden Unit 4 for the benefit of Unit 3,
c. The Junction Box Easement shall burden Unit 5 for the benefit of Unit 6.
d, The Junction Box Easement shall burden Unit 10 for the benefit of Unit 9,
e. The Junction Box Easement shall burden Unit 7 for the benefit of Unit 8,

ADD NEW NOTE 5 TO EASEMENT SECTION, AS FOLLOWS:
5, Pedestrian Easement. A non-exclusive easement to the owners of all Units within Block
E on over and across that portion of the Common Area depicted on this Plat at "Common
Driveway Easement Units 1 thru 6 and 13" for pedestrian ingress and egress to all such Units.
ADD THE FOLLOWING WHERE INDICATED UNDER "VACATION AND
RELOCATION OF EASEMENTS:
Existing Drainage Easements and Utility Easements created by the Final Plat and the Phase 1
Plat are hereby vacated by the Declarant pursuant to its reservation ofrights on the Final Plat and
the Phase 1 Plat, and are relocated as described in Easement Notes 1 and 2 of this Plat.
ADD THE FOLLOWING TO THE END OF EASEMENT NOTE 2:
That portion of the Drainage Easement located across Unit 5 created by this plat is hereby
limited in scope to only such area of Unit 5 that lies below any and all building improvements
constructed upon any such affected Lot and the right of ingress and egress to the Drainage
Easement shall not include the right to enter upon improvement located above the Drainage
Easement without the prior consent of the owner of Unit 5, An easement is hereby reserved by
Declarant and granted to all successors in the ownership of Unit 5 for the encroachment of
building improvements as currently constructed (or as reconstructed in substantially the same
manner) into the Drainage Easement.

2. Under plat title state that Subdivision was approved pursuant to Board
of County Commissioners Resolution # _ and # __'
3. In Community Development Director's signature block amend to
Planning Department to Community Development Department.
4. Label common driveway as Stein Way. Name was approved by City
Council and platted.
5. All ofthe City Engineer's Comments must be reflected on the final set
of two mylar plats in addition to the Community Development

This is the preliminary redline review submission, Note that this subdivision is an
expansion from the existing Block E subdivision which has already been recorded,
Additionally, we have made every attempt to include all the information necessary for
approval. Block E however, is currently under construction, The first home will be sold
at the end of December '01 and the final unit sometime next slUmmer. That being said,
while we will have substantial grading and plantings complete this fall, final grade and
landscaping will not be installed until next year.
We request that upon completion of the overall project (next summer), that we re-
submit for a plat amendment which will recognize the final condition of the site,
