AN ORDINANCE OF THE CITY COUNCIL OF ASPEN, COLORADO, EXTENDING
FOR A PERIOD OF THREE (3) MONTHS THE TEMPORARY MORATORIUM ON THE
ACCEPTANCE AND/OR PROCESSING OF ANY APPLICATION FOR A BUILDING
PERMIT FOR THE DEMOLITION OR REMOVAL OF ANY STRUCTURE SURVEYED IN
THE 1980 ASPEN INVENTORY OF HISTORIC SITES AND STRUCTURES, AS
AMENDED, IMPOSED BY ORDINANCE NO. 41 (SERIES OF 1986)
WHEREAS, on September 22, 1986, the City Council of the City
of Aspen adopted Ordinance No. 41 (Series of 1986) creating a
moratorium on the demolition or removal of any structure surveyed
in the 1980 Aspen Inventory of Historic Sites and Structures, as
amended; and
WHEREAS, after lengthy study and debate, the City is still
in the process of adopting legislation for the implementation of
the Aspen Area Comprehensive Plan: Historic Preservation Element;
and
WHEREAS, the continuation of the moratorium for a period of
three (3) months is necessary to study and consider changes to
the Zoning Code of the City of Aspen, Colorado, as they pertain
to a demolition and review procedure, including, deciding whether
to employ a mandatory City designation procedure, townsite
historic district, or similar approach to protect the historic
character of Aspen.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
The moratorium set forth in Section 1 of Ordinance No. 41
(Series of 1986) is hereby extended for a period of three (3)
months, to and including June 22, 1987.
Section 2
During the aforesaid moratorium, the Building Inspector is
hereby directed to not issue any permits for the demolition or
removal of structures surveyed in the 1980 Aspen Inventory of
Historic Sites and Structures, as amended.
Section 3
The City Council may, by resolution, exempt a pending
application from the restriction of this moratorium, if, upon
special review, after considering the recommendation of the
Historic Preservation Committee, it finds that the structure
proposed to be removed or demolished is not, in fact, histori-
cally or architecturally significant.
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 5
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinance.
Section 6
A public hearing on the ordinance shall be held on the
day of , 1987, in the City Council
Chambers, Aspen City Hall, Aspen, Colorado.
