SUMMARY:
Aspen Skiing Company, owner, has applied for an administrative exemption from
the 8040 Greenline Review to build a new timing shack to be located near the
base of Lift lA for the World Cup. The shack will be replacing an existing shack
and re-Iocated to a different area on the mountain. Please see the enclosed site
plan for details. The proposed shack is 192 square feet and is not going to be a
permanent structure, in that there will be no foundation.
The applicant has received approval from the Parks Department for the location
and any of the trees being removed are below the size required for a permit.
Staff recommends the Community Development Director approve this
exemption with conditions.

ZONING:
Conservation (C).
BACKGROUND:
The applicant has an existing timing shack for World Cup on the east side of the
Lift I A and would like to shift the location to the west side and further up the
mountain.
STAFF COMMENTS:
Because development is proposed above the 8040 Greenline, the proposal is
subject to review under Section 26.68.030 of the Land Use Code. Section
26.68.030(B), Exemption, states that the eXpansion, remodeling or reconstruction

of an existing development shall be exempt from 8040 greenline review if the
following standards are met:
1. The development does not add more than ten (10) percent to
the floor area of the existing structure or increase the amount of
square footage of areas of the structure which are exempt from
floor area calculations by more than twenty-five (25) percent.
Staff Finding:
The new shack is being built to replace an existing structure and is similar in size.
2. The development does not require the removal of any tree for
which a permit would be required pursuant to Section 15.04.450 or
the applicant receives a permit pursuant to said section.
Staff Finding:
No trees which require a permit will be affected by this development.
3. The development is located such that it is not affected by any
geologic hazard and will not result in increased erosion and
sedimentation.
Staff Finding:
There is no geologic hazard and the development will not result in an increase in
erosion or sedimintation.
RECOMMENDATION:
This application meets the review criteria for an exemption from the 8040
Greenline Review by the Director. Staff recommends the Director approve this
exemption with the following two conditions:
1. A building permit must is approved and issued prior to installation of the
structure.
2. All construction, materials and staging will be contained on site.
ApPROVAL:
I hereby approve this 8040 Greenline Exemption for the World Cup timing shack
on Aspen Mountain, near Lift IA as shown on the site plan enclosed with the
application with the two conditions listed above.

Dear Julie Ann,
Enclosed with this cover letter is a Land Use Application for the relocation of the
temporary World Cup Timing Building near the base of Aspen Mountain's Shadow
Mountain (Lift I-A) side.
Joyce Ohlson and Sarah Oates suggested during the pre-application conference that this
application might be dealt administratively because it is essentially a "temporary" structure
as well as a replacement of an existing structure. They also implied that applying for an
exemption from the 8040 Greenline Review is also appropriate.

2. APPLICANT understands and agrees Ihat City of Aspen Ordinance No. 57 (Series of 2000)
establishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent
to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nalure or scope of the proposed project, it
is not possible at Ihis time to ascertain Ihe full exlenl of Ihe COSls involved in processing Ihe applicalion.
APPLICANT and CITY further agree that il is in the inlerest of Ihe parties that APPLICANT make paymenl of an
initial deposit and to thereafter permil additional costs to be billed to APPLICANT on a monlhly basis.
APPLICANT agrees additional COSIS may accrue following their hearings andlor approvals. APPLICANT agrees he
will be benefited by retaining greater cash liquidily and will make additional paymenls upon notification by Ihe
CITY when Ihey are necessary as COSIS are incurred. CITY agrees it wiIl be benefited Ihrough Ihe greater certainly
of recovering ils fuIl costs 10 process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient infonnalion to the Planning Commission andlor Cily Council to enable the Planning
Commission andlor Cily Council to make legaIly required findings for project consideration, unless current billings
are paid in full prior to decision.
5. Therefore, APPLICANT agrees Ihal in consideration of Ihe CITY's waiver of its right 10 coIlect
full fees prior to a detenninalion of application completeness, APPLICANT shaIl pay an initial deposit in Ihe
amount of $ which is for hours of Communily Developmenl staff time, and if actual
recorded costs exceed the initial deposil, APPLICANT shaIl pay additional monthly billings 10 CITY 10 reimburse
Ihe CITY for the processing oflhe application menlioned above, including post approval review at a rale of$205.00
per planner hour over the initial deposit. Such periodic paymenls shaIl be made wilhin 30 days of the billing date.

After an inspection on Ajax Mountain the following conclusions were made., The tree to be
removed is a small three (3) inch diameter Aspen that does not meet the code requirements for a
tree permit to be filed. However this has been submitted as a formality and will be granted based
on the'fact that this tree is under code.
No mitigation value will be set for this tree.
