Include a purpose statement on the plat similar to the purpose statement included
in your cover letter dated November 22, 2002.
2• On Sheet 2, label the parking spaces that are limited common element as being
designated for the ADUs as is consistent with approved site plan.
3 • Obtain a letter of consent from the property owner to the west to al low for the
fence that encroaches onto his/her property to be mauitained. In addition, please
obtain a Ietter of consent from the utility agency in which the 10" underground
utility easement benefits to allow for the encroaching fence to be maintained.
Alternatively, if the casement language allows for such an encroachment, please
provide said language at the time of submitting mylar copies liar signature.
4. Please provide language that allows for the stone planter and parking area to be

EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT is entered into as of August 25, 2000, by and
between RK LAND & CATTLE COMPANY, LLC, A COLORADO LIMITED
LIABILITY COMPANY, ("(rrantor"), and TCI OF NORTHERN NEW JERSEY, whose
address is;01 446C k5PF•vd_ ("Operator").
THE PA1tTMS HERETO AGREE AS FOLLOWS:
1. Cuut of Easement_ For valuable consideration, the receipt and sufficiency of which
are hereby acknowledged, 0tw or hereby grants to Operator, its successors and assigns, an
irrevocable, uon-exclusive easement in gross to the Property (as defined in. section 2) for the
installations maintenance, operation, removal and repair of underground utility lines and
cables or other similar underground facilities, including, without limitation, amplifiers and
other electronic equipment (the 'Facilities'. Grantor hereby agrees that the Facilities shall
remain the property of Operator, removable at Operator's option. The easement shall include the
right to enter the Property for installation, maintenance, operation and removal of the Facilities
during normal working hours. However, such right to enter shall extend to any time, day r night,
where Operator determines that the maintenance, repair, operation or removal cannot wait until
normal working hours. Grantor warrants that he has title to the Property and that Operator shall
havc peaceable enjoyment of such easement.

6. Grantor, for himself, his heirs, successors and assigns, covenants
that the Property shall not be used in any manner which might interfere with or damage the
Facilities, or which might interfere with the maintenance, operation ar removal of the Facilities.
This provision shall not prohibit Grantor from installing fencing, paving or landscaping.

I represent RK Land & Cattle Company, LLC, a Colorado limited liability company
(the "Applicant"). I am the Manager of the Applicant, and, for purposes of this application,
please also consider me to be the representative of the Applicant.
The Applicant is the sole owner of the real property that is legally described in the
proof of ownership prepared by Stewart Title that is included in this package (the
"Property"), which Property is located entirely within the City of Aspen. The street
addresses of the Property are 1243 & 1245 East Cooper, Aspen, CO 81611.
The Applicant has constructed a duplex residential project on the Property. The
purpose of this application is to condominiumize that duplex and to create two separate legal
parcels of real property. The condominium is to be known as "Ute East Residences".
Please find enclosed a copy of the "Pre -Application Conference Summary"
document that you faxed to me on or about September 11, 2002. I have tried to follow that
document in preparing this application. Accordingly, the Applicant offers the following
responses to the numbered items listed on that Summary:
Please find enclosed a total deposit of $460.
2. Please find enclosed a proof of ownership, prepared by Stewart Title.
3. Please accept this letter as setting forth the Applicant's name, address, and
telephone number, as well as the name, address and telephone number of the Applicant's
representative.
4. Please accept this letter as providing a summary of the Applicant's request to
condominiumize the subject residential duplex. The standards from the City's land use code
pertaining to Condominiumization (§26.480.090) are addressed (a) by providing the general

Applicant and the Aspen/Pitkin County Housing Authority; and (b) Accessory Dwelling
Unit Deed Restriction, dated June 9th 2000, and recorded July 17, 2000, at Reception No.

THiS ACCESSORY DWELLING UNIT DEED RESTRICTION is made and

Apply. Planner reviews case for completeness and sends to Engineering and referral agencies. 2-3 weeks later planner
will contact applicant with the suggestions from Engineering for preparation of the Final Plat. The applicant's surveyor
makes those changes and brings in 2 reproducible mylar copies to the planner. Planner reviews plat for consistency with
Engineering suggestions and the Director approves, approves with conditions, or denies application based on consistency
with the review criteria and technical considerations. Plat is then signed by Comm. Dev. Engineer. Applicant records the
final plat at the County Clerk and Recorder (fee).
