The applicant, Savanah Lirrlited Partnership, represented by VallO Associates, LLC, is
requesting a 45-day extension of the deadline for thesubmissloIlofthe,final PUD
development plan application. for the Barbee, Parkirig LofiiiiCl MmeDumpApart-
ments properties. Pursuant to Section 26.445.030(D) of the Code, the applicant has
until April 9, 2001 to submit the final PUD application.
The reason for the extension request is to allow additionaltiine for the applicant's
consultants to fmalize the,r~quired suhIIli~sjg!1 mati::Iials. The property was until
recently under contract and the purch,!ser was to have completed the approval
process. The contract, however, has expired and the applicant is now diligently
working to prepare and submit the final PUD application.
Pursuant to Section 26.445.030(D), the City Council may, at its sole discretion and
for good cause shown, grant an extension of the deadline.
RECOMMENDATION:
The Community Development Department recommends approval of a 45-day exten-

Please consider this letter a formal request to extend the deadline for the submission
of the final PUD development plan application for the Barbee, Parking Lot and Mine
Dump Apartment properties. The request is submitted pursuant to Section 26.445.030
(D) of the City's PUD regulations by Savanah Limited Partnership, the owner of the
property. Section 26.44S.030(D) permits the City Council to extend the deadline
upon a showing of good cause.
The final PUD development plan application for the project must be submitted within
one year of the receipt of conceptual PUD development plan approval. Conceptual
PUD approval was granted by the City Council on April 9, 2001 pursuant to Resolu-
tion No. 20, Series of 2001. Consequently, the project's fmal PUD application must
be submitted on or before. April 9, 2002. Failure to submit the fmal PUD develop-
ment plan application within this time period renders the conceptual approval null and
void.
While Savanah is attempting to submit the required final PUD application by the April
9 deadline, we are concerned that insuffiQieIlt time remaiIls in which to finalize the
required submission dOQuments. The property was uIltil recently undercont~~ct, and
the purchaser was to hflve cQmpleted the approval p~ocess. The contract, however,
has expired, and Savanah is no"", diligently working to prepare the final PUD applica-
tion. As I'm sure you are aware, the project is quite complex, and extensive input is
required f!,om various consultants . While their work is expected to be completed in
the next few weeks, an extension of the deadline would insure that sufficient time is
available to prepare and submit the required application.

2002 City Council Agenda. While we are amenable to any reasonable extension
request, forty-five days should be sufficient for our consultants to complete their
work. If approved, the revised submission deadline would be May 24, 2002.
