Community Development Department's Comments
1. Add plat note that indicates that all parking spaces are at least 8'6"
wide and 18' long on page 3 as required by the City Land Use Code.
2. Add plat note granting easement across Lot 9B for the benefit of
accessing the lower level of Lots 2 and 5. Please point out plat note if
it already exists.
3. Add reception number for easement where Parking Garage encroaches
onto Lot 7.
4. All of the City Engineer's Comments must be reflected on the final set
of two mylar plats in addition to the Community Development
Department's comments.

Dear James:
Enclosed are two (2) copies of the Aspen Highlands Lot 9B Condominium Map for city
review, approval, and signatures. Lot 9B is the second phase of the Resident Parking
fl S P E n area and is very similar to the Lot 9A map that we processed in February 2001.
N I G N L A n D S We tried to incorporate all of Nick Adeh's comments on previous maps on this map to
reduce the revision time. In addition, Alpine Engineering, the surveyor, has contacted
V I L L A 6 Nick Adeh to insure that this map meets the city's requirements regarding
monumentation. Alpine has included copies of the Colorado Land Survey Monument
Record for the monuments of interest to aid in Engineering in their review. Please
advise if there is any additional work required beyond what has been submitted to meet
P. O. Box 51 15 City requirements.

1. The purpose of this condominium map is to create 105 Parking Units, together with the common elements as
depicted hereon, and pursuant to the Declaration for Aspen Highlands Village Parking and Loading Dock Facility, a Condominium.
2. Basis of Bearing: Record bearing of N89'39'34"W between the Center 1/4 corner and the West 1/4 corner of Section 14,
T 10 S. R 85 W of the Sixth P.M. , as shown on the 1978 B.L.M. Dependent Resurvey and Survey of said township recorded at
Pitkin County, Colorado, and as cited on the Final Plat, Aspen Highlands Village P.U.D., recorded October 15, 1998 in Plat
Book 47 at Page 1 as Reception No. 423275 in the Office of the Pitkin County Clerk and Recorder.

modified or amended or otherwise indicated on this condominium map.
7. PUD Guide. The land included in this condominium map is subject to the terms, conditions and provisions of the Aspen
Highlands Village Planned Unit Development Guide recorded in the Office of the Clerk and Recorder of Pitkin County,
Colorado, on October 15, 1998, under Reception No. 423274, and Resolution 98-254 recorded August 25, 2000 as
Reception No_ 434844, as the some may be amended from time to time.
8. Master Declaration. The property included in this condominium map is subject to the terms, conditions, easements and
provisions contained in or established by the Declaration for Aspen Highlands Village, recorded in the Office of the Clerk and
Recorder of Pitkin County, Colorado, on October 15, 1998, under reception No. 423272, as the some may be
amended from time to time (the "Master Declaration").
9. The property described in this condominium map is subject to the terms, conditions and provisions of the Declaration for
Aspen Highlands Village Parking and Loading Dock Facility, a Condominium, dated January 10, 2001 and recorded on January 11,
2001, under Reception No. 450452 as amended and supplemented by the First Supplement thereto dated _ _-__-, 2002
and recorded , 2002 under Reception No. in the Office of the Clerk and Recorder of
Pitkin County, Colorado (the 'Declaration").
10. Any of the areas on this condominium map not specifically labeled otherwise shall be General Common Elements.
11. Parking Units 139B and 149E are partial parking spaces and are created on this Map with the intention that such spaces
be combined with Parking Units 139A and 149A, respectively, which were created on the Phase 1 map, so that such pairs
of Parking Units will each constitute one parking space. Parking Unit 139A shall not be conveyed separately from Unit 139B,
and such two units shall at all times be owned by one and the some party. Parking Unit 149A shall not be conveyed separately
from Parking Unit 149B, and such two units shall at all times be owned by one and the same party. In accordance with the
terms of the Declaration, each of Parking Unit 139A and Parking Unit 139E and Parking Unit 149A and Parking Unit 149E shall

12. Hines Highlands Limited Partnership hereby grants to Ville Residences Condominium Association, a Colorado non-profit
corporation ("Wille"), a condominium owners association formed for the purpose of governing a project located on Lot 3,
Aspen Highlands Village P.U.D., Block D, City of Aspen, Pitkin County, Colorado, according to the Supplemental Plat thereof
recorded September 28, 1999 in Plat Book 51 at Page 41, as Reception No. 436003 ("Lot 3"), a perpetua. erclus'veeasement
in and to that portion of the common elements of the Project identified on this condominium map as -ELEC. R.C.E." for
purposes of the installation, maintenance, repair and replacement of electrical utility facilities which will serve Lot 3, and ail
improvements constructed thereon. In consideration of this grant of easement, Ville shall be solely responsible for all
maintenance, repair and replacement of such easement area and improvements thereon. In addition, Hines Highlands Limited
Partnership hereby grants to Ville an easement across such other portions of the General Common Elements identified on this
condominium map as are reasonably required for access to the "ELEC. R.C.E.".
13. Hines Hi hlands Limited Partnership hereby grants to (i) Maroon Creek Station Condominium Association, a Colorado nonprofit
corporation"Moroon Creek Station"), a condominium owners association formed for the purpose of governing a project located on
Lot 5, Aspen Highlands Village P.U.D., Block D, City of Aspen, Pitkin County, Colorado, according to the Fifth Amended Plat of
Aspen Highlands Village P.U.D., Block D, recorded August 27, 2001, in Plat Book 58 at Page 47, as Reception No. 458000 ("Lot 5"),
and (ii) Aspen Highlands Condominium Association, a Colorado non-profit corporation ("AHCA"), a condominium owners association
formed for the purpose of governing a project located on Lot 2, Aspen Highlands Village P.U.D., Block D, City of Aspen, Pitkin County,
Colorado, according to the Fifth Amended Plat of Aspen Highlands Village P.U.D., Block D, recorded August 27, 2001 in Plat Book 58
at Page 47, as Reception No. 458000 ("Lot 2") and Lots 4 and 8, Aspen Highlands Village P.U.D., Block D, City of Aspen, Pitkin County,
Colorado, according to the Supplemental Plat thereof recorded September 28. 1999, in Plat Book 51 at Page 41 as Reception
No. 436003 ("Lots 4 and 8"), a perpetual, exclusive easement in and to that portion of the common elements of the Project identified
on this condominium map as "GAS R.C.E." for purposes of the installation, maintenance, repair and replacement of natural gas utility
facilities which will serve Lots 2, 4 and 5, and all improvements constructed thereon. In consideration of this grant of easement,
Maroon Creek Station and AHCA shall be solely responsible for all maintenance, repair and replacement of such easement area and
improvements thereon. In addition, Hines Highlands Limited Partnership hereby grants to AHCA and Maroon Creek Station an easement
