AN ORDINANCE APPROVING AN INTERGOVENMENTAL AGREEMENT BETWEEN THE
CITY OF ASPEN, PITKIN COUNTY, AND THE TOWN OF SNOWMASS VILLAGE,
FOR THE SHARING AND APPORTIONING OF THE ANNUAL COSTS OF LEASING
AND OPERATING THE PISTEN BULLY EQUIPMENT LEASED BY THE CITY FROM
JINCO LEASING CORP. AND USED BY THE ASPEN NORDIC COUNCIL FOR THE
PURPOSE OF THE MAINTENANCE OF CROSS COUNTRY SKIING TRAILS AND
APPROVING AN AGREEMENT BETWEEN THE CITY OF ASPEN, AND THE ASPEN
NORDIC COUNCIL SETTING FORTH THE TERMS AND CONDITIONS FOR THE USE
OF THE PISTEN BULLY EQUIPMENT BY THE ASPEN NORDIC COUNCIL, AND
AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS ON BEHALF OF THE
CITY OF ASPEN
WHEREAS, there has been submitted to the City Council an
Intergovernmental Agreement between the City of Aspen, Pitkin
County, and the Town of Snowmass Village, providing for the
sharing and apportioning of the annual costs incurred by the City
in connection with the leasing of the Pisten Bully equipment
leased from JINCO Leasing Corp., which equipment will be used by
the Aspen Nordic Council for the maintenace of cross country
skiing trails, a copy of which agreement is annexed hereto and
made a part hereof; and
WHEREAS, there has also been submitted to the City Council
an Agreement Regarding the Use of Equipment setting forth the
terms and conditions for the use and operation of the Pisten
Bully equipment by the Nordic Council for the maintenance of
cross country skiing trails, a copy of which agreement is annexed
hereto and made a party hereof.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve that
Intergovernmental Agreement providing for the sharing and
apportioning of costs incurred by the City in connection with the
lease of the Pisten Bully equpment from JINCO Leasing Corp. and
that Agreement Regarding Use of Equipment providing for the use
of the Pisten Bully equipment by the Aspen Nordic Council, copies
of which agreements are annexed hereto and incorporated herein,
and does hereby authorize the Mayor to execute said agreements
and all other documents approved by the City Attorney as may be
necessary to accomplish said transaction on behalf of the City of
Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinances.
Section 4
A public hearing on the ordinance shall be held on the
day of ~ ~L~/' , 1987, in the City Council
Chambers, Aspen y Hall, Aspen, Colorado.
