AN ORDINANCE AMENDING SECTIONS 22-2 (B) 22-26(5), 22-27 OF THE
MUNICIPAL CODE OF THE CITY OF ASPEN SO AS TO ENHANCE ENFORCEMENT
OF THE PARKING REGULATIONS OF THE CITY OF ASPEN
WHEREAS, the City of Aspen, Colorado (hereinafter referred
to as "City"), has adopted by ordinance provisions of the Model
Traffic Code relating to the enforcement of parking regulations;
and
WHEREAS, the Model Traffic provisions adopted by the Aspen
Ci ty Council do not regulate continuous parking at the same or
similar location in excess of seventy-two hours (72); and
WHEREAS, the City of Aspen has heretofore adopted parking
regulations prohibiting the parking of motor vehicles at the same
location on public streets and alleys in excess of seven-two (72)
hours ; and
WHEREAS, the regulations adopted by the Aspen City Council
prohibiting the parking of motor vehicles at the same or similar
locations on public streets and alleys in excess of seven-two
(72) hours do not provide for assessing the costs of tagging and
towing vehicles violating the aforementioned regulations; and
WHEREAS I City, desires to amend sections of the adopted
Model Traffic Code relating to parking enforcement, as well as
other regulations adopted by the Aspen City Council relating to
parking enforcement; and
WHEREAS, amendments to sections 22-2, 22-26(5), 22-27 of the
Municipal Code of the City of Aspen are necessary to create the
necessary changes to the City's parking regulation; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 22-2 (b) of the Municipal Code of the City of
Aspen, Colorado, is hereby repealed and re-enacted to read as
follows:
"(B) Additions or Modifications. The said adopted code is
subject to the following additions or modifications.
Section 10.5 Parkinq not to obstruct traffic or
maintenance. No person shall park any vehicle upon a
street or highway in such a manner or under such
condi tions as to interfere with the free movement of
vehicular traffic or proper street or highway mainten-
ance or to leave any vehicle parked at the same place,
or substantially the same place, for a period of
seventy-two (72) hours."
section 2
That Section 22-26(5) of the Municipal Code of the City of
Aspen, Colorado, is hereby repealed and re-enacted to read as
follows:
"section 22-26(5) When a vehicle is parked at the same place
continuously or substantially the same place continuously
for a period of seventy-two (72) hours."
section 3
That Section 22-27 of the Municipal Code of the City of
Aspen, Colorado, is hereby repealed and re-enacted to read as
follows:
"Sec. 22-27. Charges for release
No vehicle removed and stored or impounded as provided for
in this article shall be released until all charges for
towing or otherwise removing such vehicles, processing the
paperwork, together with the charges for storage of the same
shall have been paid or exonerated. The charges for towing,
removing, processing, storage and impoundment of such
vehicle shall be established by the City Council."
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the
