ORDINANCE NO. SI
SERIES OF 1987
AN ORDINANCE ESTABLISHING MONTHLY WATER RATES AND CHARGES FOR
METERED, NON-METERED, AND CONSTRUCTION RATE CITY OF ASPEN WATER
CUSTOMERS FOR THE YEAR 1988, AMENDING SECTION 23-43 (a)5 OF THE
MUNICIPAL CODE OF THE CITY OF ASPEN TO MODIFY THE EXTRAORDINARY
WATER USAGE DEFINITION, AND AMENDING SECTION 23-101 OF THE
MUNICIPAL CODE OF THE CITY OF ASPEN TO INCLUDE CONSTRUCTION RATES
FOR WATER UTILITY SERVICE.
WHEREAS, in 1985 the City Council adopted Ordinance =II 27
which endorses the Comprehensive Water Management Plan (WMP) for
the city of Aspen, Colorado, which plan provides, among other
things, for a structure of rates and charges to fully and fairly
recover the costs of water service, including debt service, so
that all costs of such water service are paid by the customers of
such service rather than by general or other city funds; and
WHEREAS, Ordinance =II 27 describes the service areas of the
Aspen water utility in section 23-42 (a) and specifies the
weighting factors assigned to the service areas in section 23-42
(b); and
WHEREAS, Ordinance =II 27 specifies that the rates for monthly
metered service for the demand, out-of-city service, fire
protection, pumping, and variable charges shall be set according
to the criteria outlined in Section 23-43 on an annual basis; and
WHEREAS, Ordinance =II 27 specifies that the rates for monthly
unmetered service shall be set according to the criteria outlined
in section 23-102 (a) and (b);
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
section 1
That section 23-101 is hereby repealed and reenacted to read
as follows:
"section 23-101 Monthly rates for metered water service.
a) All metered customers except temporary construction accounts
shall pay the sum of charges 1) through 6) that follow:
1) A demand charge of $6.5380 per ECU per month with a
service area factor of 1.0.
2) A variable charge of $.5299 per thousand gallons of
ordinary water use per month.
3) A variable charge of $1.0598 per thousand gallons of
extraordinary water use per month as defined in section 3
of this ordinance.
4) A pumping charge of $.6420 per thousand gallons pumped
per month with service per one pump station.
5) An out-of-city service charge of $7.5789 per ECU per
month with a service area factor of 1.0, for customers
who are outside the city limits.
6) A fire protection charge of $.0619 per ECU per month with
a service area factor of 1.0.
b) Construction accounts shall pay demand, out-of-city (if
applicable), ,and fire protection charges at the same
rates as above for metered customers. Variable and
pumping charges will be waived for a maximum of six
months, or the duration of the construction project,
whichever is less. Construction account ECU's will be
based on information shown on the building permit."
section 2
That section 23-102 is hereby repealed and reenacted to read
as follows:

"section 23-102 Monthly rates for unmetered water service.
a) All unmetered customers shall pay the same monthly
rates as metered customers for demand, out-of-city
service, and fire protection charges. Unmetered
customers shall also pay a flat rate for estimated
gallons used and average pump stations required to
deliver water to their service area in lieu of the
variable and pumping charges. In addition a surcharge of
$23.00 per ECU per month will be assessed to unmetered
customers. Said surcharge shall continue to be paid for
as long as the water service remains unmetered or the
surcharge is waived by the Water Department Super-
intendent because of unusual or special circumstances.
b) For the purposes of calculating the monthly flat rate
charges in lieu of the variable and pumping charges,
the levelezied thousands of gallons used by and/or
pumped to the unmetered customer shall be estimated by
the superintendent based on comparable usage and pumping
by metered customers and on other pertinent information."
section 3
That section 23-43 (a) 5 is hereby repealed and reenacted to
read as follows:
"section 23-43 (a)5:
Monthly water use in excess of 30,000 gallons per month
per ECU shall be considered extraordinary water use, and the
monthly variable charge shall be double the amount charged
for ordinary water use."
section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
section 5
A public hearing on the ordinance shall be held on the
