AN ORDINANCE ESTABLISHING A TOWING FEE OF $45.00 FOR ANY VEHICLE
IMPOUNDED UNDER THE AUTHORITY OF SECTION 22-20 OF THE MODEL
TRAFFIC CODE FOR COLORADO MUNICIPALITIES WITH ADDITIONAL AUTHORI-
ZATION TO AMEND THE AFOREMENTIONED TOWING FEE BY RESOLUTION IN
THE EVENT THE IMPOUND LOT IS RE-LOCATED TO A SITE OUTSIDE THE
CITY OF ASPEN
WHEREAS, the towing fee for any motor vehicle impounded
under the authority of section 22-20 of the Model Traffic Code
for Colorado Municipalities was raised from twenty dollars ($20)
to forty dollars ($40) in 1980.
WHEREAS, the City Council of the City of Aspen desires to
increase the towing fee from forty dollars ($40) to forty-five
($45) to reflect the increase in cost of providing towing
services incurred in the last six years.
WHEREAS, the City Council may, by resolution, amend the
forty-five dollar ($45) towing fee by no more than ten dollars
($10) to reflect potential increases in the cost of towing
vehicles to a more distant impound location.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
The City of Aspen shall charge a vehicle storage fee of ~
per day and a towing fee of forty-five dollars ($45) for any
vehicle impounded under the authority of Section 22-20 of the
Model Traffic Code for Colorado Municipalities.
Section 2
In the event that the impound lot located north of Spring
street is relocated to a site outside the limits of the City of
Aspen, City Council may, by resolution, amend the forty-five
dollar ($45) towing fee by no more than ten dollars ($10) to
reflect in the increased cost of towing vehicles to a more
distant location.
section 3
All ordinances, or parts thereof in conflict herewith are
repealed. This ordinance, immediately upon its passage, shall be
recorded in the City Clerk's book of ordinances kept for that
purpose, authenticated by the signatures of the Mayor and City
Clerk and shall be published as required by law.
section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.

A public hearing on the ordinance shall be held on the /~
