A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
GRANTING A TEMP0~RY ~S~ PE~iT TO ~LLOW ~OR THE ENCLOSURE OF
CARBIOU ALLEY, 431 E~ HopKINSi COLLI~S BLO~ ~g~E~ ~L~DO

WHEREAS, pursuant to Section 26.450 of the Aspen Municipal Code, the Applicant,
Harley Baldwin has sUbmitted an application for a Temporary Use Permit to allow the enclosure
of Caribou Alley located at 431 E. Hopkins; and,
WHEREAS, the Applicant requestS this use from March 10, 2003 to September 10,
2003; and,
WHEREAS, the Community Development Department reviewed the temporary use
application and recommends that the City Council approve the temporary use permit with
conditions; and,
WHEREAS, City Council finds that the proposed temporary use is consistent with the
character and existing land uses of the surrounding parcels and neighborhood and that granting
the temporary use permit will not adversely impact the neighborhood; and,
WHEREAS, City Council finds that granting the temporary use permit will further the
public interest and weifare by bringing Caribou Alley into compliance while the applicant seeks
land use approval.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN,
COLORADO~ THAT:
Section 1: In accordance with Sec6on 26.450.020 of t!~e A~pen Municipal Code, the City
Council of the City of Aspen, Colorado, does hereby grant Harley Baldwin, a temporary use
permit to enclose Caribou Alley at 431 E. Hopkins with the following conditions:
1. The applicant will apply for a Waiver from the open space requirements from HPC, if said
amendments have been approved prior to September 10, 2003.
2. If the amendments have not been approved, or if the application is denied, the applicant
will remove the roof and door structure from Caribou Alley, on or before September 10,
2003, to bring the building in to compliance with the open space requirements of the
Aspen Municipal Code, SectiOn 26.575.030.

before the City Council of the City of Aspen, Colorado.
