AN ORDINANCE AMENDING DIVISION 3 ARTICLE III OF CHAPTER 23 OF THE
MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, ENTITLED "WATER
RATES AND CHARGES" SETTING FORTH A PROVISION FOR DEALING WITH
HARDSHIP CASES BY ADMINISTRATIVE MEANS, AND SETTING FORTH A
PROVISION FOR DEALING WITH QUALIFIED SENIOR CITIZENS BY ADMIN-
ISTRATIVE MEANS.
WHEREAS, if a verifiable hardship exists and upon the
approval of both the Finance Director and the Water Superinten-
dent special billing arrangements may be made for such hardship
cases; and
WHEREAS, the City Council desires that water charges be as
low as possible to senior citizens whose financial resources are
limited; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Division 3 of Article III of Chapter 23, of Municipal
Code of the City of Aspen, Colorado be and hereby is amended to
read as follows:
A. That section 23-102 (d) be amended to read as follows:
With respect to the water rates and charges contained
in section 23-101 and 23-102, above, in case of
verifiable hardship and upon the approval of both the
Finance Director and the Water Superintendent, special
billing arrangements may be made. Further, any senior
citizen who applies to the City Finance Department for
lower water rates, and who meets the guidelines as the
Finance Director and the Water Superintendent may
establish, will have their water rates adjusted as
follows: metered residences will be charged only the
demand, out-of-the city service charge,and fire
protection charges (Section 23-101, 1) , 5) and 6))
determined by the location of their residence and
number of Equivalent Capacity Units. Flat rate
residences (Section 23-102) will be charged 35 % of the
total charge for unmetered water service (Section 23-
102, a)) determined by the location of their residence
and number of Equivalent Capacity Units.
Section 2
The senior citizen rates contained in Section 1 of this
ordinance shall become effective as of December 15, 1987.
Section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision of such holding shall not affect the validity of the
remaining portions.
Section 4
A public hearing on the ordinance shall be held on the
day of /~ ,1988, at 5:00 P.M. in the City Council
Chambers, Aspen City Hall, 130 South Galena Street, Aspen,
Colorado.
