AN ORDINANCE AMENDING ORDINANCE NO.1 (SERIES OF 1986) TO ORGANIZE
CITY DEPARTMENTS INTO FOUR AGENCIES AND ONE DEPARTMENT, TO BE KNOWN
AS "PLANNING AND ZONING DEPARTMENT", "DEPUTY CITY MANAGER AGENCY",
"PUBLIC WORKS AGENCY", "PUBLIC SAFETY AGENCY", AND "LEISURE SERVICES
AGENCY"
WHEREAS, pursuant to Ordinance No. 1 (Series of 1986), the City Council
approved the organization of existing city departments into five agencies; and
WHEREAS, upon the recommendation of the City Manager, the City Council
desires to amend Ordinance No. 1 (Series of 1986) and approve and authorize
the City Manager to merge the functions of the Building, Environmental Health,
Housing, Finance, Personnel, Data Processing, and Municipal Court with the
Deputy City Manager; the Planning and Zoning Department to be with the
City/County Manager; and rename the Public Services Department to Public
Works; such that City departments will be organized into four agencies and one
department to be known as "Planning and Zoning Department", "Deputy City
Manager Agency", "Public Works Agency", "Public Safety Agency", and "Leisure
Services Agency"
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO:
Section I
That Ordinance No. 1 (Series of 1986) is hereby amended to provide that
City departments be organized into four agencies and one department, as
follows:
Planning and Zoning Department, which shall include the "City"
function of the joint City/County departments of Planning and Zoning to be
headed by the City/County Manager.
Deputy City Manager Agency, which shall include the "City" function
of the joint City/County departments of Building, Environmental Health, Data
Processing, and including City Departments of Finance, Personnel, and Municipal
Court to be headed by the Deputy City Manager.
Public Works Agency, including the City departments of Engineering,
Electric, Water and Streets to be headed by the Director of Public Works.
Public Safety Agency, including the City Police Department, and the
"City" function with regard to the joint City/County Departments of Animal
Control and Communication, to be headed by the Director of Public Safety.
Leisure Services Agency, including Parks, Recreation, Municipal Golf
Course, Ice Garden, and the Wheeler Opera House to be headed by the Director of
Leisure Services.
Section 2.
If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3.
Nothing in this ordinance shall be construed to affect any right, duty or
liability under any ordinances III effect prior to the effective date of this
ordinance, and the same shall be continued and concluded under such prior
ordinance.
Section 4.
A public hearing on the ordinance shall be held on the d~~ day of
