ORDINANCE NO. 48 ~'~'~%~ ·

AN ORDINANCE OF THE ASPEN CITY COUNCIL REPEALING THE MODERATE-
DENSITY RESIDENTIAL (R-15A) ZONE DISTRICT AND REZONING THOSE
LANDS PRESENTLY ZONED MODERATE-DENSITY RESIDENTIAL (R-15A) TO
MODERATE-DENSITY RESIDENTIAL (R-15)
WHEREAS, one provision of Ordinance 51, Series of 1989,
amends the requirements for duplexes in the Moderate-Density
Residential (R-15) zone district; and
WHEREAS, the effect of this provision would be to make the
zone district regulations of the Moderate-Density Residential (R-
15) and Moderate-Density Residential (R-15A) zone districts
virtually identical; and
WHEREAS, since the two zone districts would be virtually
identical, it will be less confusing if they are combined into a
single zone district and all lands be designated on the Official
City of Aspen Zone District Map accordingly.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO:
Section 1
That Article 5, Zone Districts, of the Aspen Land Use
Regulations, Sec. 5-102 (3), Moderate-Density Residential (R-15
A); Sec. 5-203, Moderate-Density Residential (R-15 A); the
reference to the Moderate-Density Residential (R-15 A) zone
district in the table of required off-street parking spaces in
Sec. 5-303; and the reference to the Moderate-Density Residential
(R-15A) zone district in Sec. 7-1008 (A) (1) (b) (1) are hereby
repealed, and that a reference to the Residential/Multi-Family
(R/MF-A) zone district be added to Sec. 7-1008 (A) (1) (b) (1).
Section 2
That all lands designated on the official City of Aspen Zone
District Map as Moderate-Density Residential (R-15 A) are hereby
rezoned to Moderate Density Residential (R-15).
Section 3
That the Zone District Map be and hereby is amended to reflect
the zoning described in Section 2 and that the Planning Director
is hereby authorized and directed to amend said map to reflect
the new zoning.
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 5
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinance in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinances.
Section 6
A public hearing on the Ordinance shall be held on the
day of , 1989, at 5:00 P.M. in the City Council
Chambers, Aspen City Hall, Aspen, Colorado, fifteen (15) days
prior to which hearing notice of the same shall be published once
in a newspaper of general circulation within the City of Aspen.
