AN ORDINANCE TO REPEAL AND REENACT SECTIONS 7-157, A~ENDMENT, SO
AS TO PERMIT ALL ELECTRICAL WIRING IN GROUP A, E, I, M AND B
OCCUPANCIES, AS DEFINED IN THE UNIFORM BUILDING CODE, TO BE
ENCASED IN APPROVED RACEWAYS AND REPEALING AND REENACTING SECTION
7-108 CONCERNING THE REGISTRATION OF ELECTRICAL CONTRACTORS
WHEREAS, the City Council of the City of Aspen, Colorado, in
1968, by Ordinance No. 46 (Series of 1968), adopted the National
Electrical Code as further amended by Ordinance No. 55 (Series of
1974), and Ordinance No. 2 (Series of 1978); and
WHEREAS, the Chief Building Official of the Aspen/Pitkln
Regional Building Department has recommended that Section 7-157,
amendment, be repealed and reenacted so as to permit all electri-
cal wiring in Group A, E, I, H and B occupancies, as defined in
the Uniform Building Code, to be encased in approved raceways,
excepting low voltage wiring for audio, signaling and, thermo-
stats, which shall be accepted in any method approved for the
area served; and
WHEREAS, the City Council desires to repeal and reenact
Section 7-108 of the Municipal Code of the City of Aspen to
delete reference to a $10.00 registration fee which is no longer
required; and
WHEREAS, the City Council has determined that the aforemen-
tioned amendment is in the interest of health, safety and welfare
of the people of the City of Aspen, Colorado.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 7-157, amendment, of the Municipal Code of the
City of Aspen, Colorado, is hereby amended to read as follows:
"All electrical wiring in Group A, E, I, H and B occupan-
cies, as defined in the Uniform Building Code, shall be
installed in an approved raceway, excepting low voltage
wiring for audio, signaling and thermostats, which shall be
accepted in any method approved for the area served."
Section 2
That Section 7-108 of the Municipal Code of the City of
Aspen, Colorado, is hereby repealed and reenacted to read as
follows:
"Sec. 7-108. Reqistration of electrlcal contractors.
As a condition of performing services within the City,
electrical contractors shall register themselves with the
board of examiners and appeals. Applicants for registration
must demonstrate that they hold a valid electrical contrac-
tor's license issued by the state. Registrations made under
this section shall terminate on the last day of the fiscal
year."
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 3
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordinances in effect prior to
the effective date of this ordinance, and the same shall be
continued and concluded under such prior ordinances.
Section 4
A public hearing on the ordinance shall be held on the
