ORDINANCE NO. 30
(SERIES OF 1990)
AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING SUBDIVISION
EXEMPTION FOR THE CONDOMINIUMIZATION OF 729/731 CEMETERY LANE,
LOT 12.
WHEREAS, pursuant to section 7-1007 of the Aspen Land Use
Code, a Condominiumization is at subdivision exemption by the
Clty Councll; and
WHEREAS, Doug Wiser, Aspen One Investment Partners, has
submitted an application for the condominiumization of the
Ironwoods located at 729/731 Cemetery Lane; and
WHEREAS, the Engineerlng Department, having reviewed the
application has made referral comments; and
WHEREAS,
the
Planning Office,
havlng reviewed the
appllcation pursuant to Sectlon 7-1007,
and havlng revlewed the
referral comments from Engineering and Housing,
recommends
approval with the following conditions:
1. Prior to the signature of the final plat -
a. the plat shall be reviewed and approved by the Englneering
Department;
b. a certlfied engineer must determine that historic runoff
shall be malntalned;
c. 729/731 Cemetery Lane shall be restricted by approved and
recorded, with the Housing Authorlty, deed restrlctions to
provide six month mlnimum leases, wlth not more than two shorter
tenancies per year; and
d.
an affordable housing impact fee shall be paid in the amount

of $16,100.00 to the Houslng Authority with a receipt glven to
the Finance Dlrector and Planning Office.
WHEREAS, the Aspen city Councll having consldered the
Planning Department's recommendations for condominlumization
does wish to grant the requested subdivision exemption for the
Ironwoods, 729/731 Cemetery Lane.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
section 1:
That is does hereby grant a subdlvision exemptlon for
condominiumization, with the prevlously mentioned conditions of
approval, recommended by the Aspen Plannlng Department, to
Ironwoods, 729/731 cemetery Lane, Lot 12, Sectlon 12.

Section 2:
That the city Clerk be and hereby is directed, upon the
adoption of this ordinance, to record a copy of this ordinance in
the office of the Pltkin county Clerk and Recorder.
section 3:
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalld or
unconstitutional by any court of competent jurisdiction, such
provision and such holding shall not affect the validity of the
remainlng portions thereof.
section 4:
Nothing in this ordinance shall be construed to affect any
right, duty or liability under any ordlnance in effect prior to

the effectlve date of this ordJ.nance, and the same shall be
contlnued and concluded under such prior ordlnances.
section 5:
A public hearing on the Ordinance shall be held on the 14
day of May, 1990 at 5:00 P.M. in the city Councll Chambers, Aspen
city Hall, Aspen Colorado, fifteen (15) days prior to which
hearlng a public notice of the same shall be published one in a
newspaper of general circulation within the City of Aspen.
