(SERIES OF 1990)
AN ORDINANCE OF THE CITY OF ASPEN GRANTING AMENDMENT TO THE PUD
FINAL DEVELOPMENT PLAN FOR THE AMBRIDGE ACCESSORY OFFICE
STRUCTURE AT 195 PARK CIRCLE
WHEREAS, Shirley Ambrldge submltted to the Planning Office
an application for Amendment to the PUD Final Development Plan to
construct a 480 square foot Home Occupatlons office structure at
195 Park Circle; and
WHEREAS, on April 17, 1990, a public hearing was held before
the Aspen Planning and Zoning Commission and in a 6-1 vote
approved the Amendment to the PUD Final Development Plan wlth
conditions, and recommended to Council the approval of the Final
PUD with conditlons:
1. Reductlon of the size of the structure to comply with the 50%
llmltation requirement.
Work with Zoning Staff to flnallze
calculatlon of floor areas.
2. Adherence to item H of the Home occupations regulating the
vlsibillty of the business from any other resldential structures,
that the home occupation must not take place outside of this new
structure.
3. Only electricity will serve the proposed structure.
Prior to issuance of a Building Permit, the following must occur:
4. The applicant shall verify to the Engineerlng Department the
buildable area.
Surface easements shall be documented by
provldlng Schedule B from a current title, or a stamped, signed
statement from an Architect or Engineer.

Environmental Health Department and EPA for lnformatlon on
handling the waste.
6. The appllcant shall submit for Planning's approval a
landscape plan WhlCh shows a vegetation buffer at least 4' wide
between the parklng area and proposed structure.
7. The applicant must submit to the Building Department a soils
report and englneering report for the conditions and deslgn of
the slope (composition, compactlon, grade, etc.)
Within 180 days of City Council's approval of this plan the
following must occur:
8. A Final PUD Plan and PUD agreement must be filed with the
County Clerk as requlred by section 7-907 of the Land Use Code.
WHEREAS, pursuant to section 7-903 of the Aspen Land Use
Code, the city Council may grant approval to Final PUD
Development Plans; and
WHEREAS, the Aspen City council having considered the
Planning and Zoning commission's recommendation, does wish to
grant the Final PUD Development Plan request for the Ambridge
Accessory Office structure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:

That it does hereby grant Final PUD Approval with the
previously mentioned conditions recommended by the Plannlng and
Zoning Commlssion to the Ambridge Accessory Offlce Structure.

That the city Clerk be and hereby is dlrected, upon the
adoption of thlS ordlnance, to record a copy of this ordinance ln
the offlce of the Pitkin county Clerk and Recorder.
section 3:
If any section, subsection, sentence, clause, phrase or
portion of thlS ordinance is for any reason invalld or
unconstitutional by any court of competent jurlsdlction, such
provision and such holding shall not affect the validity of the
remainlng portions thereof.
section 4:
Nothing ln this ordinance shall be construed to affect any
rlght, duty or liabillty under any ordinance in effect prior to
the effectJ.ve date of thlS ordlnance, and the same shall be
continued and concluded under such prior ordlnances.
Section 5:
A public hearing on the Ordinance shall be held on the
day of
, 1990 at 5: 00 P.]!!. in the city Councll Chambers,
Aspen city Hall, Aspen Colorado, fifteen (15) days prior to WhlCh
a hearing of pUblic notice of the same shall be published in a
newspaper of general circulatlon within the city of Aspen.
