HomeMy WebLinkAboutordinance.council.038-90 ;'tt ,,_ e ORDINANCE NO. 38 (SERIES OF 1990) AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING SUBDIVISION EXEMPTION FOR THE CONDOMINIUMIZATlON OF THE BENNETT DUPLEX WHEREAS, pursuant to section 7-1007 of the Aspen Municipal Code (rev1s1on date 8/14/89), a Condominiumizat1on 1S a Subd1vis1on Exempt10n by the City Council; and WHEREAS , Michael and Janice Bennett have submitted an appl1cation for the Condominiumization of the1r duplex located at 534 Spruce st., lots 3 and 4, Block 10, Williams Add1tion; and WHEREAS , the Eng1neer1ng Department, having reviewed the applicat10n has made referral comments; and WHEREAS, the planning Office, having reviewed the application pursuant to Section 7-1007 of the Aspen Municipal Code relat1ng to condominium1zat1on, and reviewing the referral comments from Engineering, recommends approval with conditions. NOW, THEREFORE, BE IT ORDAl NED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1: That it does hereby grant a Subdivision Exemption for condom1niumization to the Bennett duplex at 534 Spruce st., Lots 3 and 4, Block 10, Williams Add1tion, with the followings cond1t1ons: Prior to recording the plat with the Pitkin County Clerk and Recorder's office: 1. The applicant needs to agree to ]Oln 1n a special 1mprovement d1strict, if one is ever formed. 2. The applicant needs to submit an eng1neering report and - (e . calculations which confirm that the histor1c runoff will be mainta1ned. 3. The applicant needs to submit for the Eng1neering Department's approval two cop1es of a final plat. 4. The appl1cant must submit to the City Attorney's off1ce for approval a Subdivis10n Exemption Agreement descr1bing the terms of this exempt1on. This agreement must be filed w1th the P1tkin County Clerk and Recorder concurrently with the condomin1umizat1on plat. 5. Rental of either unit shall be restr1cted to 6 month m1nimum leases, with no more than 2 shorter tenancies per year. 6. Prior to the Planning Director sign1ng the f1nal plat for condom1nium1zat1on the applicants shall pay the affordable hous1ng fee to the Housing Authority for processing to the City Finance Department. The fee shall be $8,050. If the applicant requests waiver of the fee, a deed restr1ction of the new unit to res1dent occupancy must be filed with the Hous1ng Authority before the Planning Director will sign the plat. section 2: That the city Clerk is directed, upon the adopt1on of this ord1nance, to record a copy of this ordinance 1n the office of the pitkin County Clerk and Recorder. section 3: A public hearing on the Ordinance shall be held on the ~S~ day or Aspen C1ty Hall, Aspen Colorado, fifteen (15) days prior to which , 1990 at in the Chambers, ci ty Council 5:00 hearing a public notice of the same shall be published in a i.
