AN ORDINANCE EXTENDING THE GROWTH MANAGEMENT QUOTA SYSTEM
DEVELOPMENT APPLICATION SUBMISSION DATE FOR RESIDENTIAL ALLOT-
MENTS FOR 1990.
WHEREAS, Section 24-8-106(A) of the Municipal Code of the
city of Aspen presently establishes annual submission dates for
development applications under the Growth Management Quota System
(GMQS); and
WHEREAS, the annual submission date deadline for residential
development allotments is currently established as November 1 for
any given year; and
WHEREAS, the City, in the public interest, has been exten-
sively involved in the potential private development of certain
lands and areas within the City through public hearings, studies,
investigation and negotiation; and
WHEREAS, as a result of the City's participation and ever-
sight activities regarding potential private development, certain
property owners and/or developers have been or may have been
delayed in their timely preparation or in their ability to timely
prepare residential development allotment submissions pursuant to
existing GMQS time requirements; and
WHEREAS, the City Council of the City of Aspen deems it
appropriate and equitable and in the public interest to extend
the GMQS development submission deadline for 1990 residential
development allotments so as to mitigate any prejudice that may
have accrued as a result of the City's aforementioned oversight
activities to any person wishing to apply for residential devel-
opment;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:
Section 1
The final date for the submission and acceptance of
applications for 1990 residential development allotments pursuant
to the Growth Management Quota System requirements, Section 24-8-
106(A) of the Municipal Code, shall be and is hereby extended
from November 1, 1990, to and until February 15, 1991.
Section 2
Nothing herein shall alter the submission deadline dates for
1990 Tourist Accommodations or Commercial/office development, nor
shall the allotment quotas currently established under existing
ordinances in any way be affected by the extension of the submis-
sion deadline date as provided in Section 1 above.
Section 3
This ordinance shall not have any effect on existing litiga-
tion and shall not operate as an abatement of any action or
proceeding now pending under or by virtue of the ordinances
repealed or amended as herein provided, and the same shall be
continued and concluded under such prior ordinances.
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or

unconstitutional in a court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and shall not affect the validity of the remaining
portions thereof.
Section 5
A public hearing on the ordinance shall be held on the ~
day of ~ , 1990, in the city Council
Chambers, Aspen City Hall, Aspen, Colorado.
