AN ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING SUBDIVISION
EXEMPTION FOR THE CONDOMINIUMIZATION OF THE KELLNER DUPLEX
LOCATED AT 728-730 W. BLEEKER (LOT 5 VICTORIA SQUAi~E SUBDIVISION)
WHEREAS, pursuant to Section 7-1007 of the Aspen Municipal
Code (revision date 8/14/89), a Condominiumlzation is a
SubdIvision Exemption by the City Council; and
WHEI{EAS, Matthew Kellner has submitted an application for
the condom~niumlzatlon of the duplex located at 728-730 W.
Bleeker, Lot 5 Victoria Square SubdIvision; and
W~EI{EAS, the Engineering Department, having reviewed the
application has made referral comments; and
WHEREAS, the Planning Office, having reviewed the
application pursuant to Section 7-1007 of the Aspen Municipal
Code relating to condomin~umization, and reviewing the referral
comments from EngineerIng, recommends approval w~th conditions.
NOW, THEI~EFOi~E, BE IT ORDAINED BY THE CITY COUi~CIL OF THE
CITY OF ASPEN, COLORADO:
Section 1:
That it does hereby grant a Subdivision Exemption for
condominiumization to the Kellner duplex at 728-730 W. Bleeker,
Lot 5 Victoria Square Subdivision, with the following conditions:
1. Landscaping or other work in the right-of-way requires a
permit from the C~ty Streets Department.
2. Rental of either unit shall be restricted to 6 month minimum
leases, with no more than 2 shorter tenancies per year. This
shall be a f~led amendment to the Condominium Declarations.
3. Prior to the Planning Director signing the final plat for
condom~niumization the applicant shall pay the affordable housing
fee to the Planning Office for processing to the City Finance
Department. The fee shall be $16,100.00 ($8,050 per unit.)
Prior to recording the plat with the Pitkin County Clerk and
Recorder:
4. A revised Victoria Square landscaping plan reflecting
treatment of the Seventh St. frontage shall be submitted and
approved by the Planning Office.
5. The Vicinity Map on the Plat shall be corrected to show the
L-3 zoned area as LP.
6. The parcel's development must conform to the C~ty's drainage
requirements as per Section 24-7.1007.C.4.f. Driveway drains
may be required. The applicant needs to submit an engineerIng
report and calculations which conf~rm that the historic runoff
will be maintaIned.
7. Parking spaces, dumpster area and utility meter locations must
be shown on the plat.
8. The applicant must verify receipt of an ExcavatIon Permit for
the recent alley paving project.
9. The Pedestrian Easement on the plat requires a legal
description, suitable to the Engineering Department and the City
Attorney.
10. A notes section on the plat must contain a Subdivision
Exemption Agreement describing the terms of this exemption.
11. The applicant needs to submit for the Engineering
Department's approval two copies of a final plat. Technical
elements discussed in the Engineering referral comments must be
addressed.
Section 2:
That the City Clerk is directed, upon the adoption of this
ordinance, to record a copy of this ordinance in the office of
the Pltkin County Clerk and Recorder.
Section 3:
A public hearing on the Ordinance shall be held on the /~
day of ~ , 1990 at 5:00 in the City Council Chambers,
Aspen City Hall, Aspen Colorado, fifteen (15) days prior to which
hearing a public notice of the same shall be published in a
newspaper of general circulation within the City of Aspen.
