Kevin indicated that it was necessary at times to buy California grapes. In fact ~' found out from Patrick Leto that he was buying California grapes this last year. We want to correct this. · We have a growers market. That is, we sell what we grow. We do, however, have a provision that allows vendors to sell up to 20% of their product from "off farm" sources. Under that condition Kevin's friends could constitute 20% of his gross but since he has no wine that would be difficult. · In the case of people who process their product rather than grow it, e.g., pasta or bakery or even wine folks, the processing had to be done by the vendor and in Colorado. If the vendor processed and grew their own product, e.g., Homestead Meats. all the better. Thus, a vendor must process an0/or grow their own product up to at least 80% of their sales. These are criteria which we have developed over a period of six years and some did not come without a significant amount of discussion. They are criteria which the group holds dearly. In Patrick's case the criteria got bent too far and we want to correct that. If, for some reason, we need to re-evaluate then we wil do so. At this time and in the case of wine vendors we had a vendor who conformed ideally and one who demanded we stretch our policy more than we wanted. Therefore, the choice of wine vendors was a "no brainer". If, on the other hand, both vendors met the criteria exactly, we would consider a joint venture or perhaps two separate booths. There is the possibility that my facts regarding Kevin are incorrect and therefore it is wise to ask Kevin to respond. I'll get Becky to come Saturday. Dear day, In review of the certificate of insurance you faxed to me with respects to Valley Valet, Inc., I believe that the City of Aspen needs to do their due diligence in seeking the following answers in order to protect the City of Aspens but all pa~-ons that use the services of Valley Valet, Inc. #1. Should a claim occt~r, there is no agent of record shown in the top left comer in which to contact. Since it would be nearly impossible to pu~ a claim directly through Lloyds of London due t° Re number of syndicates that writs this coverage on behalf of Lloyds the City should have on file the name and phone # to contact n case of a claim. t~2. This Certificate confers nc changes t~ the actual policy and no rights on b?half of the City of Aspen, even though someon.e typed in the Certificate Holder box, Additional Insured". Please note the top right hand box and the bottom right hand box. In other words, this certificate cf insurance is only as good as the agent's errors and omissions policy and the City don't even know who the agent is. #3. The only way to truly confirm proper coverage is to see an actual copy of the full and complets policy along w~ an endorsement adding the City of Aspen as an additional insured. Given this policy was bound effective 1/31/03, surely the insu~ed'~as his policy by now. The City should have their Risk Management department 6r City Attorney review the policy for the following items: #1. That the appropriate location where vehicles are being parking for the City of Aspen is endorsed to We policY. ~2. Verify that there is coverage in the amount of ~1 000 000 per location as required by the City's contract. #3. The certificate of insurance specifics 20 parking spaces but if in fact there are more spaces'will this void the coverage? . _ ~,. Apparently Jay's Valet was informed ~hat their bid was not considered or perhaps disqualifi,ed based on the certificate of insurance provide~ within their bid as it was viewed as "not valid based on the statement bhat it wasa "sample'. If this in fact was done. this was an error on the pa~t of the City of Aspen. This certificate is a sample showing ~e carrier, coverage, limits and term of the policy ~at is in place and at, ye for Jay's valet. Coverage could have simply I~en verified by either calling the agent listed on the ce~ficate of insurance in ~e top le~t hand comer or calling ~he carrier direct and providing the policy #. Since this was a bid process, we would not confirm coverage to the City for a location l~at had not been awarded to our client un~l t~e. contract was awarded. At the ~me the contract is awarded, it would then be appropriate to issue a new cerlificate providing the City of Aspen as an additional insured with respects to a specific roca~on/oontract.
