HomeMy WebLinkAbout25_MAROON_CREEK_CABIN25.1The Maroon Creek Cabin the maroon creek cabin section 25 25.2 Bar Slash X Ranch LLC - Annexation and Stage Road PUD/Subdivision: Final Submission Introduction The section of Maroon Creek Canyon within the ranch has high ecological value and is being protected with a specific Conservation easement (see Sections 14 and 15). Unfortunately, and probably because of its beauty and seclusion, this area has suffered in recent years from an increasing amount of trespass. This has included camping, lighting of fires, wanton breakage of plants and trees, and depositing of trash and human excre - ment. As a result, Bar/X Ranch proposed as part of the subdivision that a small cabin should be built on an area of the canyon floor that is high and dry, out of the 100 year flood plain, and devoid of riparian vegetation. This cabin will play the same role in preventing trespass and damage at the north end of this section of canyon that the Harvey and Caudill residences play at the south end. 25.3The Maroon Creek Cabin Environmentally Sensitive Area The Cabin is in an Environmentally Sensitive Area according to Section 26.435.040 of the LUC - Stream Margin Review. The ESA requirements are covered in the previous Section 24, which need to be read in conjunction with this Section 25. Additional Restrictions In addition to the ESA requirements, the Preannexation Agreement placed the following addi- tional restrictions on the Cabin site, which are called out in the PUD Control Document. 1 Bar/X Ranch has agreed to limit the construction of the cabin to those periods of time deter- mined to be reasonable by the City during the land use approval process. This was determined to be July through September - see letter on next page. 2 Following the construction of the cabin, Bar/X Ranch will be responsible for the complete restoration of any construction access roads or utility access easements required during construction. Bar/X believes that the Cabin can be entirely constructed using the proposed funicular (incline elevator) and that road access will not be required. Sewer service is available immediately adjoining the Cabin site, and with an individual well and photovoltaic power, no utility trenching will be required. Phone and cable service will be carried in conduit down the funicular structure. 3 The right to build a cabin will be subject to Bar/X Ranch being able to satisfy reasonable requirements for the provision of fire and emergency services; provided, however that due to the desire to avoid direct, year round, road access to the cabin, alternative access such as via a stairway or funicular is permitted. The proposed funicular + staircase location is shown on the Composite Plansheet. 4 The cabin will be sprinklered, a fire hydrant, hoses and other non-vehicular fire fighting equipment will be placed at or near the cabin. Aditionally, Bar/X Ranch will execute a waiver and release of claims in favor of the City and all emergency service providers for any injuries, death, or property damage which may occur due to the absence of a year round road to the cabin. 5 The lot containing the cabin will be burdened with restrictive covenants that prohibit the construction of a future access road to the cabin site; (2) limit lighting of the cabin to periods of time when it is occupied; (3) prohibit dogs on the cabin site at all times; and (4) limit exterior construction to the months of July through September of each year. 6 The Cabin will have an allowable floor area of 1,500 square feet. Floor areas will be mea- sured by using the City floor area regulations for square footage inclusions and exclusions as of June 1, 2000. 7 The cabin will have the right to be served by an individual well. (If such well is provided, the water rights otherwise attributable to the Cabin need not be conveyed to the City, or if they have been conveyed prior to the time the well is put to beneficial use, then the rights will be reconveyed by City to Bar/X Ranch. 25.4 Bar Slash X Ranch LLC - Annexation and Stage Road PUD/Subdivision: Final Submission Recommendations from Bar/X Ranch’s ecological consultant regarding the Cabin construction.
