REQUEST: The applicant, David H. Koch, is seeking approval for a
sUbdivision exemption to eliminate a lot line between the Second
Aspen Company Subdivision lots 9 and 16, pursuant to Section 24-
7-1003(A) (1) of the Aspen Municipal Code.

The Code authorizes the Planning Director to approve an

permit an insubstantial boundary change between adjacent
parcels; and

Response: The applicant has not stated a specific hardship. The
owner is interested in expanding the floor area of the residence
on Lot 9 by utilizing the available floor area on Lot 16.
Presently the allowable floor area on Lot 9 is 5049.78 sq. ft. and
Lot 16 is 5074.56 sq. ft. Should this lot line adjustment be
approved, the total allowable floor area for the newly combined lot
would be 6524.7 sq. ft. Therefore, the result of the lot line
adjustment is a decrease of 3599.64 permitted floor area and one
unit of density.
d. The corrected plat will meet the standards of this
division, and conform to the requirements of this
chapter, including the dimensional requirements of the
zone district in which the lots are located, except in

cases of an existing nonconforming lot, in which the
adjustment shall not increase the nonconformity of the
lot; and
Response: The Second Aspen Company Subdivision is zoned R-15. The
combining of these lots does not create any non-conforming
situations. The 18 lot subdivision has lots that range in size
from 15,241 sq. ft. to 60,830 sq. ft. Two lots in the subdivision
will be larger than this combined parcel.
e. It is demonstrated that the lot line adjustment will not
affect the development rights or permitted density of the
affected lots by providing the opportunity to create a
new lot for resale or development.
Response: The development rights for the construction of a new
residence on Lot 16 will be terminated. As mentioned under item
c. above, the lot line adjustment will result in a decrease in the
permitted floor area by about 3600 sq. ft. Therefore this lot line
adjustment will affect the development rights and permitted density
of the these lots, however, the net effect will be less density and
floor area than is currently permitted on the parcels.
RECOMMENDATION: The Planning Office recommends that the Planning
Director approve the applicant's request for the lot line
adjustment as it complies with the requirements of section 24-7-
1003(A) (1) of the Aspen Municipal Code, subject to the following
conditions:
1. The Plat shall be signed and recorded within 180 days
from the date of this approval, otherwise the approval
will be rendered null and void.
