Health Other: 0 0 MEMORANDUM TO: Stan Clauson, Community Development Director FROM: Mary Lackner, Planner RE: Second Aspen Company Subdivision Exemption for a Lot Line Adjustment DATE: May 15, 1995 ---------------------------------------------------------------- ---------------------------------------------------------------- REQUEST: The applicant, David H. Koch, is seeking approval for a subdivision exemption to eliminate a lot line between the Second Aspen Company Subdivision lots 9 and 16, pursuant to Section 24- 7-1003(A)(1) of the Aspen Municipal Code. CRITERIA: The Code authorizes the Planning Director to approve an adjustment of a lot line if all of the following conditions are met: a. It is demonstrated that the request is to correct an engineering or survey error in a recorded plat or is to permit an insubstantial boundary change between adjacent parcels; and Response: The lot line adjustment can be considered an insubstantial boundary change, because of the decrease in allowed density and floor area on the newly created parcel. b. All landowners whose lot lines are being adjusted provide written consent to the application; and Response: David Koch is the owner of both parcels that would be affected by the lot line adjustment. C. It is demonstrated that the request is to address specific hardship; and Response: The applicant has not stated a specific hardship. The owner is interested in expanding the floor area of the residence on Lot 9 by utilizing the available floor area on Lot 16. Presently the allowable floor area on Lot 9 is 5049.78 sq. ft. and Lot 16 is 5074.56 sq.ft. Should this lot line adjustment be approved, the total allowable floor area for the newly combined lot would be 6524.7 sq.ft. Therefore, the result of the lot line adjustment is a decrease of 3599.64 permitted floor area and one unit of density. d. The corrected plat will meet the standards of this division, and conform to the requirements of this chapter, including the dimensional requirements of the zone district in which the lots are located, except in i 0 CJ cases of an existing nonconforming lot, in which the adjustment shall not increase the nonconformity of the lot; and Response: The Second Aspen Company Subdivision is zoned R-15. The combining of these lots does not create any non -conforming situations. The 18 lot subdivision has lots that range in size from 15,241 sq.ft. to 60,830 sq.ft. Two lots in the subdivision will be larger than this combined parcel. e. It is demonstrated that the lot line adjustment will not affect the development rights or permitted density of the affected lots by providing the opportunity to create a new lot for resale or development. Response: The development rights for the construction of a new residence on Lot 16 will be terminated. As mentioned under item c. above, the lot line adjustment will result in a decrease in the permitted floor area by about 3600 sq.ft. Therefore this lot line adjustment will affect the development rights and permitted density of the these lots, however, the net effect will be less density and floor area than is currently permitted on the parcels. RECOMMENDATION: The Planning Office recommends that the Planning Director approve the applicant's request for the lot line adjustment as it complies with the requirements of Section 24-7- 1003(A)(1) of the Aspen Municipal Code, subject to the following conditions: 1. The Plat shall be signed and recorded within 180 days from the date of this approval, otherwise the approval will be rendered null and void.
