HomeMy WebLinkAboutordinance.council.029-94 . ~ '. ~ ., ORDINANCE NO. ~9 Series of 1994 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, AUTHORIZING THE CERTIFICATION OF DELINQUENT CHARGES FOR COLLECTION BY THE PITKIN COUNTY TREASURER IN THE SAME MANNER AUTHORIZED FOR COLLECTION OF OTHER TAXES. WHEREAS, various provisions of the municipal code of the City of Aspen, Colorado provide for the imposition of charges and fees; and WHEREAS, in some instances the city of Aspen is required to enforce payment of delinquent charges incurred pursuant to provisions of the municipal code; and WHEREAS, Colorado state statutes authorize municipalities, by ordinance, to provide for the collection of delinquent charges by county treasurers in the same manner applicable to taxes; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. That the Municipal Code of the City of Aspen, Colorado, is hereby amended by adding a section, which section reads as follows: Sec. 1 - 17. Certification of Delinquent Charges. The city Clerk may cause any or all delinquent charges, assessments, or taxes made or levied by the city of Aspen, pursuant to the terms of this code or otherwise, to be certified to the treasurer of Pitkin County to be collected and paid over by the treasurer of Pitkin County in the same manner as taxes are authorized to be by statute. e section 2. This ordinance shall not have any effect on existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances amended as herein provided, and the same shall be construed and concluded under such prior ordinances. section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions hereof. e.
