ORDINANCE NO. 98~) (Series of 1
AN ORDINANCE ADOPTING THE PRECISE PLAN FOR THE JAIL FACILITY
SPECIALLY PLANNED AREA (SPA) AND REZONING THE SPA SITE TO "PUBLIC"
WHEREAS, the property described in Exhibit "A" attached here-
to and incorporated herein (hereinfter known as "the Site") is
owned or being acquired by the County (Pitkin County, Colorado),
and
WHEREAS, the other present owners involved have agreed to be
co-applicants in this request, and
WHEREAS, the Parcels 1, 2 and 3 shown on Exhibit "B" attached
hereto have been through the subdivision exception procedure for
the purpose of forming one site, and
WHEREAS, the site is being formed for the purpose of a build-
ing site for the new Pitkin County Jail Facility which is an
essential governmental project exempted from the procedures of the
Growth Management Quota System pursuant to Section 24-11.2(e) of
the Municipal Code of the City of Aspen, and
WHEREAS, the use will be for a public purpose and the largest
parcel of this Site (Parcel 1) is zoned "Public", and
WHEREAS, the County has submitted to the City of Aspen an
application which requests adoption of a precise development plan
for the Site, including the establishment of area and bulk
requirements, and an application to rezone the Site to "Public",
and
WHEREAS, at a regular meeting of the Planning and Zoning Com-
mission, held on May 4, 1982, the subdivision exception and rezon-
lng applications were approved and a tie vote was made regarding
the SPA plan, and

WHEREAS, concerns reltaed in the Planning and Zoning Commis-
sion discussion of the Site plan have been considered and revi-
sions have been made accordingly, and
WHEREAS, it is the policy of the City of Aspen that the
establishment of uses and allowable densities and other matters
pertaining to the zoning regulations for the land and structures
located on the Property should only be granted subject to appro-
priate conditions which require that development and use of the
Property shall have no significant adverse impacts on the adjacent
~andowners, stream and air quality, road congestion and wildlife,
and shall be consistent with the adopted master plan and the gen-
eral public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section
The plan for the Pitkin County Jail facility, as depicted in
the final plat of the Pitkin County Center Subdivision, incorpor-
ated herein by this reference, be and the same is hereby approved
upon the following conditions:
1. That the final plat be approved by the City Engineer as
complying with the applicable requirements of Chapter 20 of the
Municipal Code of the City of Aspen.
2. That the development comply with the "Public" zone and
the bulk and area requirements as hereinafter set forth.
Section 2
The area and bulk requirements for the site shall be as fol-
lows:
A. Minimum lot width 180 feet
B. Minimum front yard (Main Street front) 25 feet
C. Minimum side yard 30 feet
D. Minimum rear yard 10 feet
E. Maximum height 35 feet
F. Minimum distance between buildings 50 feet
G. Percentage open space 30%
H. External floor area ratio .75:1

Section 3
The zoning for Parcels 1, 2 and 3 on Exhibit "B" shall be and
hereby is changed to "Public".
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 5
A public hearing on the ordinance shall be held on the /~
day of ~ , 1982, at 5:00 P.M. in
the City Council Chambers, Aspen City Hall, Aspen, Colorado,
15 days prior to which hearing notice of the same shall be
published once in a newspaper of general circulation within the
City of Aspen.
