AN ORDINANCE PROVIDING FOR THE USE OF GENERAL ELECTION PRECINCTS
AT THE SPECIAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 2, 1982
WHEREAS, the City Council (the "Council") of the City of
Aspen, Colorado (the "Council"), in the County of Pitkin and State
of Colorado, a municipal corporation duly organized and existing
as a home rule municipal corporation pursuant to Article XX of the
Colorado Constitution, has heretofore determined, by Resolution
No. 25, adopted on August 31, 1982, to hold a special municipal
election on November 2, 1982, for the purposes set forth in said
resolutions; and
WHEREAS, Council has determined, and hereby determines, that
the use of the general election precincts for said special munici-
pal election will maximize the convenience of the voter.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
All action heretofore taken by the Council and officers of
the City, consistent with the provisions of this ordinance, toward
the special municipal election to be held November 2, 1982, be,
and the same hereby is, ratified, approved and confirmed.
Section 2
Pursuant to Section 2.3 of the City Charter, the Council has
heretofore adopted Ordinance No. 5-71, establishing multiple vot-
ing precincts. The Council has determined, and hereby determines,
that, solely for purposes of the special municipal election to be
held November 2, 1982, the City shall constitute five voting pre-
cincts, the boundaries of which shall be the same as the boundar-
ies of the general election precincts (General Election Precinct
Nos. 1, 2, 3, 4 and 5) established for use in connection with the

general election also to be held on November 2, 1982. This ordin-
anee shall supersede said Ordinance 5-71, but only as to the
November 2, 1982, special municipal election herein authorized.
Section 3
The officers of the City be, and they hereby are, authorized
and directed to take all action necessary or appropriate to
effectuate the provisions of this ordinance.
Section 4
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affeet the validity of the
remaining portions thereof.
Section 5
A public hearing on this ordinance shall be held at a
special meeting of the Council, called hereby for such purpose, on
the 9th day of September, 1982, at 8:00 A.M. in the City Council
Chambers, Aspen City Hall, 130 South Galena Street, Aspen,
Colorado.'
INTRODUCED, READ AND ORDERED published as provided by law by
the City Council of the City of Aspen, Colorado, at its adjourned
regular meeting held August 31, 1982.
