ORDINANCE NO.
(Series of 1982)
AN ORDINANCE OF THE ASPEN CITY COUNCIL OF ASPEN, COLORADO, TO
REZONE FROM PARK TO PUBLIC/SPA THE PROPERTY AT 420 EAST HOPKINS
AVENUE FOR USE AS A FIRE STATION COMPLEX
WHEREAS, the Fire District currently occupies Lots O, P, Q
and R of Block 87, City and Townsite of Aspen, also known as 420
East Hopkins Avenue, for their fire station, and
WHEREAS, the Fire District has expressed the need for an
additional bay on the existing structure, and
WHEREAS the Fire District is contemplating future additions
to the fire station at some later date, and
WHEREAS the,Thrift Shop is planning to lease a portion of
the site, and
WHEREAS the Thrift Shop can be defined as a "quasi-public"
use, and
WHEREAS the area and bulk requirements in the Public zone
are set by adoption of an SPA overlay, and
WHEREAS the uses for this SPA shall be identical to those of
the Public zone, and
WHEREAS the rezoning will allow the expansion of two uses
which benefit the community, those being the fire station and the
Thrift Shop, and
WHEREAS, the site is presently in the CC zone, but the use
has been a public use for many years, and
WHEREAS, the site is within the vicinity of other public
uses, namely the City Hall and the County Courthouse, and
WHEREAS, the green space offered by the present park area is
being retained to a degree by the site plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:

Section 1
That Lots O, P, Q and R of Block 87 which now house the fire
station and the adjacent open "Park" parcel be rezoned to "Public/
SPA" with the following area and bulk requirements attached and
allowed uses being those of the "Public" zone:
Minimum Lot Width: 120 feet
Minimum Front Yard: 5 feet
Minimum Side Yard: 0 feet
Minimum Rear Yard: 0 feet
Maximum Height: 28 feet
Minimum Distance Between
Principal and Accessory
Buildings: 0 feet
Percent of Open Space
Required for Building Site: 15%
External Floor Area Ratio: 1.25:1
Section 2
That the Engineering Department be directed to amend the
zoning map to reflect the change in zoning of Lots O, P, Q and R
in Block 87 from CC to Public/SPA.
Section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 4
A public hearing on the ordinance shall be held on the ~
day of ~, 1982, at 5:00 P.M. in the City Council
Chambers, Aspen City Hall, 130 South Galena Street, Aspen,
Colorado, 15 days prior to which hearing notice of the same shall
be published once in a newspaper of general circulation within the
City of Aspen.
