AN ORDINANCE OF THE CITY COUNCIL OF ASPEN, COLORADO,/DECLARING
ISSUES OF THE SPECIAL MUNICIPAL ELECTION OF FEBRUARY 15, 1983, TO
BE ISSUES IN WHICH THE CITY HAS AN OFFICIAL CONCERN, APPROPRIATING
FUNDS TO BE SPENT IN A PUBLIC INFORMATION CAMPAIGN RELATING TO
THESE ISSUES, AUTHORIZING CITY EMPLOYEES TO PARTICIPATE DURING
WORKING HOURS ON SAID PUBLIC INFORMATION CAMPAIGN AND AUTHORIZING
AND DIRECTING THE CITY MANAGER TO FILE A STATE CAMPAIGN REFORM ACT
REPORT IN CONNECTION WITH SAID CAMPAIGN
WHEREAS, the City Council of Aspen, Colorado, has called a
special municipal election for February 15, 1983, and set forth
the purposes of said election, to wit: Whether the City may lease
City-owned "Rubey Park" to a developer for the purpose of develop-
ing a visitor/transportation center and whether the City should
levy an occupation tax to fund a marketing effort for Aspen as a
resort; and
WHEREAS, the City Council has found that those issues are
matters of official concern; and
WHEREAS, Section 1-45-116, C.R.S. 1973, as amended, requires
specific approval of certain expenditures in connection with elec-
tions; and
WHEREAS, the City is desirous of sponsoring a public informa-
tion campaign in connection with the special municipal election;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the issues involved in the special municipal election
called for February 15, 1983, are hereby declared to be issues in
which the City of Aspen has an official concern.
Section 2
That the City Council hereby authorizes and directs the City
Manager or his designee to expend public funds and/or supplies to
a maximum total value of One Thousand Dollars ($1,000.00) in con-

nection with, and/or sponsorship of, a public information campaign
to inform the electors about the issues in said election.
Further, the Council authorizes the City Manager, at his
discretion, or his designee to authorize City employees to work
on said public information campaign during working hours.
Further, the Council authorizes the City Manager or his
designee to produce or join in advertising involving public pro-
perty and/or funds to be provided for the purpose of influencing
the vote on the special election issues, within the spending
limits as herein provided.
The City Manager or his designee is directed to secure prior
approval from City Council of the form and content of any document
or information to be disseminated to the public under this sec-
tion.
Section 3
That the City Manager or his designee is authorized and
directed to file a report on said public information campaign
under the Colorado Campaign Reform Act of 1974, as amended (Sec-
tion 1-45-101 et se~., C.R.S. 1973, as amended), or such other
statutes as may be applicable.
Section 4
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
Section 5
A public hearing on the ordinance shall be held on the /~
day of ~>~t~L~ , 198~, at 5:00 P.M. in
the City Co Chambers, Aspen City Hall, Aspen, Colorado.
