HomeMy WebLinkAboutresolution.council.111-01 A RESOLUTION OF THE ASPEN CITY COUNCIL REVERSING A DECISION MADE BY THE HISTORIC PRESERVATION COMMISSION AND THEREBY APPROVING AN APPLICATION FOR CONCEPTUAL SIGNIFICANT DEVELOPMENT AND PARTIAL DEMOLITION FOR THE PROPERTY LOCATED AT 629 W. SMUGGLER STREET, LOT A AND THE WEST HALF OF LOT B, BLOCK 21, CITY AND TOWNSITE OF ASPEN RESOLUTION NO. 111, SERIES OF 2001 WHEREAS, the applicant, Steven St. Clair, requested conceptual significant development and partial demolition approval from the Historic Preservation Commission for an addition to the historic home he owns at 629 West Smuggler Street. The property is listed on the "Inventory of Historic Sites and Structures," and WHEREAS, the Historic Preservation Commission discussed the project on Oct. 25, 2000, and February 28, April 11, June 27, and August 8, 2001. Ali of the meetings met the proper noticing requirements of Section 26.304.060.E of the Land Use Code. The. project was denied on August 8, 2001 by a vote of 3 to 1, after the Historic Preservation ~ Commission found that the review standards provided in the Land Use Code were not met; and WHEREAS, the applicant appealed the decision to the Aspen City Council; and WHEREAS, the Aspen City Council reversed the decision of the Historic Preserva~ti6fi Commission as rendered in their Resolution #36, Series of 2001; and NOW, THEREFORE, BE IT RESOLVED: City Council reverses a decision of the Historic Preservation Commission and thereby approves the application for conceptual significant development and partial demolition for the property located at 629 W. Smuggler Street, Lot A and the west half of Lot B, Block 21, City and Townsite of Aspen, Colorado, finding that there was an abuse of discretion or a denial of due process by the Commission. APPROVED by the City Council at its regulm' meeting on this 26th day of November, 2001.
