The applicant is requesting an amendment to relocate a flood wall, pursuant to Land Use Code Section 26.445.110(A). SUMMARY: The Applicant has requested an Insubstantial PUD Amendment in order relocate a flood wall that was approved on the Park Parcel to the lot line between 540 Walnut (Lot 8) and the park parcel. The wall was originally to be located on the park property in order to save a stand of trees that were located on Lot 8. Those trees have subsequently been removed, meaning the wall can be moved to a more effective location on Lot 8. STAFF EVALUATION: Staff finds that the request meets the requirements of an Insubstantial PD Amendment. The proposal is consistent with the original approvals and the character of the development, and represents an insubstantial change to the PD. DECISION: The Community Development Director finds the request to relocate the required flood wall as noted above and in Exhibit'B' is consistent with the review criteria (Exhibit C) and thereby, APPROVES the exemption as specified below. 1. The applicant must submit a building permit change order for the construction of the wall. 2. All the improvements shall comply with the City's Urban Runoff Management Plan and Construction Management Plan requirements. THE Cin' 01: AsPEN Nathan Kaegebein, Kaegebein Fine Home Building PO Box 1570 Carbondale, CO 81623 RE: 540 Walnut Flood Wall Dear Nate, The City of Aspen Parks Department is requiring tile holneowner at 540 Walnut Avenue to install the flood wall that was previously shown on the PUD to be in the Fox Crossing Park property, to now be installed on the lot line between 540 Walnut Avenue and the Fox Crossing Park property. ' The wall was originally planned in the park in order to save a stand of trees that were ultimately removed to facilitate the construction of 540 Walnut Avenue. Since the trees were removed, tile nece$sity of having the wall in the Park is no longer needed, and the flood wall needs to be installed on the properly for which it is required. Please have the homeowner of 540 Walnut Avenue sign and date to show his acceptance of this ' requirement. It will then have an administrative amendment applied to the PD and memorialized iii the building permit file. . 0 Exhibit C: Review Standards 26.445.110. Amendments. Amendments to an approved Project Review or to an approved Detailed Review shall be reviewed according to the standards and procedures outline below. Amendments to Planned Unit Development and Specially Planned Area approvals (pre-Ordinance 36,2013, approvals) shall also proceed according to the standards and procedures outline below and the Community Development Director shall determine the type ofprocedure most-applicable to the requested amendment. A. Insubstantial Amendments. An insubstantial amendment to an approved Project Review or an approved Detailed Review may be authorized by the Community Development Director. An insubstantial amendment shall meet the following criteria: 1. The request does not change the use or character of the development. Staff Finding: The proposal relocates an approved flood wall from the park to Lot 8. The dimensions are substantially similar and the purpose is the same. The wall relocation is consistent with the character and use of the development. Staff.finds this criterion is met. 2. The request is consistent with the conditions and representations in the project's original approval, or otherwise represents an insubstantial change. Staff Finding: The wall is necessary to protect development on Lot 8 from flood hazards. The relocation is minimal, and results in removal from the publically accessible park parcel. Stafffinds this criterion is met. 3. The request does not require granting a variation from the project's allowed use(s) and does not request an increase in the allowed height or floor area. Staff Finding: No changes to use are proposed. The dimensions are substantially similar and the purpose is the same. Stafffinds this criterion is met. 4. Any proposed changes to the approved dimensional requirements are limited to a technical nature, respond to a design parameter that could not have been foreseen during the Project Review approval, are within dimensional tolerances stated in the Project Review, or otherwise represents an insubstantial change. Staff Finding: The proposal relocates an approvedflood wall from the park to Lot 8. The dimensions are substantially similar to the wall that was originally approved. The original wall location was to be on the parkparcelin order to save a stand oftrees. Those trees have been removed, so the wallno longer needs to accommodate them. Because the trees were removed, some dimensional changes are necessary. These are technical in nature and are insubstantial. Stafffinds this criterion is met. 5. An applicant may not apply for Detailed Review if an amendment is pending. Staff Finding: No Detailed Review is required for this amendment. Staff finds this criterion is not applicable.
