HomeMy WebLinkAboutordinance.council.040-95 "e' ,IT.. \~''''. e'l.. \" ~< (8 ORDINANCE No.1o Series of 1995 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, TO AMEND SECTION 22-2 OF THE ASPEN MUNICIPAL CODE MODIFYING THE MODEL TRAFFIC CODE BY IMPOSING AN ABSOLUTE SPEED LIMIT AS THE MAXIMUM LAWFUL SPEED LIMIT ON CITY STREETS WITHIN THE CITY OF ASPEN. WHEREAS, section 42-4-1101(7), C.R.S., authorizes municipalities to adopt by ordinance absolute speed limits as the maximum lawful speed limits within their jurisdiction; and WHEREAS, the City Council has determined that the health, safety, and welfare of its citizens, residents, and guests require that the speed limits for vehicles within the City limits should be no greater than twenty five miles per hour unless special hazards require lower speed limits. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1 Section 22-2 of the Municipal Code of the City of Aspen, Colorado, is hereby amended by the addition of a new section 22-2 (b)(5) which section shall read as follows: (5) Section 4-1. Model Traffic Code Section 4-1 is hereby amended to read as follows: Sec. 4-1. Basic Rule - (a) No person shall drive a vehicle on a city street within this municipality at a speed greater than reasonable and prudent under the conditions existing, and in no event greater than twenty five miles per hour. 1 \e - fa.. \~~., (b) Except when a special hazard exists that requires lower speed, and except as otherwise provided herein, a speed not in excess of twenty five miles per hour shall be lawful. Section 2 This ordinance shall not have any effect on existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed of amended as herein provided, and the same shall be construed and concluded under such prior ordinances. Section 3 If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof.
