HYMAN AVENUE, LOT 1 OF THE SUND LOT SPLIT, BLOCK 35, CITY AND TOWNSITE OF ASPEN, AS "H", HISTORIC LANDMARK PURSUANT TO SECTION 24-7-703 OF THE MUNICIPAL CODE. WHEREAS, the city of Aspen I s community Development Department has filed an application for Historic Li:l.ndmark Designation of 935 E. Hyman Avenue, Lot 1 of the Sund Lot Split, Block 35, East Aspen Addition, pursuant to Section 24-7-704 of the Municipal Code; and WHEREAS, Kentco Capital Corporation, owner of 935 E. Hyman Avenue, Lot 1 of the Sund Lot Split, Block 35, East Aspen Addition, is not in support the Landmark Designation, however, owner consent is not required by the Municipal Code for landmark designation; and WHEREAS, the Historic Preservation Commission recommended Historic Designation 7-0 for the subject properties at a duly noticed public hearing on August 25, 1993; and WHEREAS, the Aspen Planning and Zoning commission recommended Historic Designation 4-1 for the subject properties at a duly noticed public hearing on September 7, 1993; and WHEREAS, pursuant to Section 24-7-702, the city Council has found that the subject property is historically significant and that the preservation of the property is necessary to enhance and preserve the character of the East End neighborhood and the Aspen community; and 1 ,a, '. ~ ~~. ' ~. 3El6876 8-798 P-105 10/31/95 08~45A PG 2 OF _., WHEREAS, City Council wishes to affirm those recommendations as rendered by the Historic Preservation commission and Planning and zoning commission and complete the Landmark Designation process; and WHEREAS, the property owner shall receive a $2,000 landmark designation grant, for which the property is eligible, and may seek other incentives available for historic landmarks. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the property at: 935 E. Hyman Avenue, Lot 1 of the Sund Lot Split, Block 35, East Aspen Addition be granted "H," Historic Landmark Designation. section 2 That the zoning District Map be amended to reflect the rezoning described in section 1 and the Planning Director shall be authorized and directed to amend said map to reflect said rezoning. Section 3 That the Community Development Director shall be directed to notify the city Clerk of such designation, who shall record among the real estate records of the Pitkin County Clerk and Recorder's Office a certified copy of this Ordinance. section 4 That if any section, subsection, sentence, clause, phrase or portion of this Ordinance lS for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof. 2 ~, . -- e;,," ,c. , 386876 B-798 P-106 10/31/95 0B:45A PG 3 DF ,:> section 5 That a public hearing on the Ordinance shall be held on the 25th day of September, 1995, at 5:00 p.m. in the City Council Chambers, Aspen city Hall, Aspen, Colorado, fifteen (15) days prior to which hearing notice of the same shall be published once in a newspaper of general circulation within the City of Aspen.
