A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
SUBMITTING TO THE ELECTORATE OF THE CITY OF ASPEN A CERTAIN
QUESTION SEEKING AUTHORITY TO SELL CITY OWNED PROPERTY FOR THE
CONSTRUCTION OF DEED RESTRICTED AFFORDABLE HOUSING FOR CITY
EMPLOYEES.
WHEREAS, the City of Aspen owns certain property, originally acquired with Open
Space funds, of approximately 10,249 square feet located north of the Aspen Post Office
and east of the Aspen Center for Environmental Studies with a legal description of Lots 1-3,
Block 4. Lakeview Addition to the City and Township of Aspen, and commonly known as
the Puppy Smith property; and
WHEREAS. the City CoUncil desires to redevelop the existing property from a
parcel containing a non-historic miner's cottage to a renovated cottage and the addition of a
duplex to be sold or leased to qualified City of Aspen employees as deed restricted
affordable housing; and
WHEREAS, the Section 13.4 of the City of Aspen Home Rule Charter requires
voter approval to convey City owned property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:
The following question, authorizing the City of Aspen to convey or lease the Puppy
Smith property to qualified City employees as three deed restricted affordable housing tm/ts,
shall be placed on the ballot at the November 4, 2003, election:
Shall the City of Aspen be authorized to sell approximately 10,249 square feet of
City owned property commonly known as the Puppy Smith property located north
of the Aspen Post Office and east of the Aspen Center for Environmental Studies
(ACES)? Said sale of City owned property shall be specifically conditioned upon the
following:
1. Prior to the start of any construction, the Parks and Open Space Fund
shall be reimbursed the sum of $250,000,00.
2. The subdivision of the property to accommodate the renovation of
the existing non-historic miner's cottage and the construction of two new
affordable housing deed restricted units of no more than a total of 3,400
square feet.
3. Two affordable housing units shall be sold or rented through the
general lottery pool as deed restricted units in accordance with the
Aspen/Pitkin County Affordable Housing Guidelines. The miner's cottage
currently occupied by a City employee shall continue to be offered to
qualified City of Aspen employees as either a sale or rental unit.
4. Prior to receiving a building permit for the project, City Council shall
by resolution identify and acquire replacement property of equivalent or
. greater value of the land as of the date of sale of the three affordable housing
units following a public hearing taking into consideration monetary,
environmental and aesthetic values.

on the 8th day of September 2003.
