COOPER AVENUE, CITY OF ASPEN, PITKIN COUNTY, COLORADO. WHEREAS, pursuant to. Sectio.n 26.100.100 o.f the Aspen Municipal Co.de, City Co.uncil may grant an extensio.n o.f GMQS allo.catio.ns up to. six mo.nths fo.r develo.pments o.ther than detached residential and duplex units; and WHEREAS, o.n February 22, 1993, City Co.uncil ado.pted Ordinance No.. 3, Series o.f 1993, which approved a GMQS allo.catio.n fo.r the redevelo.pment o.f the Bell Mo.untain Lo.dge at 720 E. .-- Co.o.perAvenue;and WHEREAS, the develo.pment allo.tments expire o.n the day after the third anniversary o.f the date the GMQS allo.catio.ns, o.r o.ther develo.pment appro.vals, have been awarded; and WHEREAS, Co.uncil has granted five (5) prio.r six-mo.nth extensio.ns which extended the GMQS allo.catio.n and vested rights to. August 22, 1998; and WHEREAS, the applicant, Bell Mo.untain Limited Liability Co.mpany, has requested ano.ther six (6) mo.nth extensio.n o.fthe GMQS allo.catio.n in o.rder to. co.ntinue wo.rking with the City to. develo.P the Independence Pass Plaza pro.ject witho.ut Io.sing the ability to. utilize the 1993 GMQS allo.catio.n if the project is no.t realized; and WHEREAS, the applicant alSo. requests an extensio.n o.f vested rights status, which was granted retro.actively by Ordinance 37, Series o.f 1993, to. co.incide with the GMQS allo.catio.n extensio.n; and Ordinance No.. _, Series af 1997 Page 2 WHEREAS, the Co.mmunity Develo.pment Department, having reviewed the applicatio.n reco.mmends approval o.f a six (6) mo.nth extensio.n o.fthe GMQS allo.tment approved in Ordinance 3, Series o.f 1993, and the vested rights extensio.n; and WHEREAS, the Aspen City Co.uncil, having co.nsidered the Co.mmunity Develo.pment Department's reco.mmendatio.n fo.r the GMQS extensio.n, do.es wish to. grant ano.ther extensio.n fo.r six (6) mo.nths and extend vested rights status to. co.incide with the GMQS extensio.n. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1: ...-' Pursuant to Sectio.n 26.100.100 o.f the Aspen Municipal Co.de, City Co.uncil do.es hereby grant the applicant ano.ther six (6) mo.nth extensio.n o.f the 1993 Lo.dge GMQS allo.catio.n approved by Ordinance 3, Series o.f 1993, extended by Ordinance 51, Series o.f 1994, Ordinance 15, Series o.f 1995, Ordinance 16, Series o.f 1996, Ordinance 39, Series o.f 1996, and Ordinance 12, Series o.f 1997 fo.r the Bell Mo.untain Lo.dge at 720 E. Co.o.per Avenue beginning August 22, 1998 and ending February 22, 1999. Section 2: Pursuant to. Sectio.n 26.52.080 o.fthe Aspen Municipal Co.de and C.R.S. 24-68-104(2), City Co.uncil do.es hereby grant the applicant an extensio.n o.f vested rights status fo.r the site specific develo.pment plan fo.r the Bell Mo.untain Lo.dge at 720 E. Co.o.per Avenue as appro.ved by Ordinance 37, Series o.f 1993, to. February 22, 1999, with the fo.llo.wing co.nditio.ns: 1. The extensio.n o.fvested rights shall be fo.r six (6) mo.nths fro.m August 22, 1998 to. February 22, 1999. 2. Land use applicatio.n fees asso.ciated with the extensio.n o.f vested rights thro.ugh this Ordinance are hereby waived. 3. The rights granted by the site specific develo.pment plan appro.ved by this Ordinance and the insubstantial amendment shall remain vested fo.r a perio.d o.f six (6) years February 22, 1993, which was retro.actively appro.ved by Ordinance 37, Series o.f 1993, ado.pted o.n July 12, 1993. Ordinance No.. _, Series af 1997 Page 3 Ho.wever, any failure to. abide by the terms and co.nditio.ns attendant to. this appro.val shall result in fo.rfeiture o.f said vested pro.perty rights. 4. The approval granted hereby shall be subject to. all rights o.freferendum and judicial review. 5. No.thing in the approvals provided in this Ordinance shall exempt the site specific develo.pment plan fro.m subsequent reviews and or approvals required by this Ordinance o.r the general rules, regulatio.ns o.r o.rdinances o.f the City pro.vided that such reviews o.r approvals are no.t inco.nsistent with the approvals granted and vested herein. 6. The establishment herein o.f a vested property right shall no.t preclude the applicatio.n o.f o.rdinances o.r regulatio.ns which are general in nature and are applicable to. all property subject to. land use regulatio.n by the City o.f Aspen including, but no.t limited to., building, fire, plumbing, electrical and mechanical co.des. In this regard, as a co.nditio.n o.f this site develo.pment approval, the develo.per shall abide by any and all such building, fire, plumbing, electrical and mechanical co.des, unless an exemptio.n therefro.m is granted in writing. Section 3: The City Clerk shall cause no.tice o.f this Ordinance to. be published in a newspaper o.f general circulatio.n within the City o.f Aspen no. later than fo.urteen (14) days fo.llo.wing final ado.ptio.n hereo.f. Section 4: If any sectio.n, subsectio.n, sentence, clause, phrase o.r Po.rtio.n o.f this o.rdinance is for any reaso.n held invalid o.r unco.nstitutio.nal by any Co.urt o.f competent jurisdictio.n, such pro.visio.n and such ho.lding shall no.t affect the validity o.f the remaining Po.rtio.ns thereo.f. Section 5: This Ordinance shall no.t affect any existing litigatio.n and shall no.t o.perate as an abatement o.f any actio.n o.r proceeding no.w pending under o.r by virtue o.f the o.rdinances repealed o.r amended as herein provided, and the same shall be co.nducted and co.ncluded under such prio.r o.rdinances. Section 6: A public hearing o.n the Ordinance shall be held o.n the 14th day o.f Octo.ber, 1997 at 5:00 P.M. in the City Co.uncil Chambers, Aspen City Hall, Aspen Co.Io.rado., fifteen (15) days prio.r to. which hearing a public no.tice o.f the same shall be published o.nce in a newspaper o.f general circulatio.n within the City o.f Aspen.
